An Act to Amend the Hospital Services Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 1 of the Hospital Services Act,

chapter H-9 of the Revised Statutes, 1973, is amended by adding the following

definitions in alphabetical order: “medical practitioner” means a member of the medical profession who is licensed to practise med- icine under the laws of the jurisdiction in which the medical practitioner practises; “oral and maxillofacial surgeon” means a dental practitioner whose name is entered in the specialists register and who is the holder of a specialist’s li- cence in oral and maxillofacial surgery issued pur- suant to the New Brunswick Dental Act, 1985 , or a dental practitioner who practises outside of New Brunswick and who is recognized as an oral and maxillofacial surgeon by the licensing body of the jurisdiction in which that dental practitioner prac- tises oral and maxillofacial surgery; PROJET DE LOI 53 Loi modifiant la

Loi sur les services hospita- liers,

chapitre H-9 des Lois révisées de 1973, est modifié par l’adjonction des définitions suivantes selon l’ordre alphabétique : « chirurgien bucco-dentaire et maxillo-facial » désigne un dentiste dont le nom est inscrit dans le registre des dentistes spécialistes et qui est titulaire d’un permis de spécialiste en chirurgie bucco- dentaire et maxillo-faciale délivré conformément à la Loi dentaire du Nouveau-Brunswick de 1985 ou un dentiste exerçant sa profession en dehors du Nouveau-Brunswick et qui est reconnu en tant que chirurgien bucco-dentaire et maxillo-facial par l’autorité compétente du territoire où il exerce sa profession; « médecin » désigne un membre du corps médi- cal qui est autorisé à pratiquer la médecine en vertu des lois du territoire où il exerce sa profession;

Section 4 of the Act is amended (

a) in paragraph (

b) by striking out “hospital corporations” and substituting “regional health authorities”; (

b) in paragraph h) of the French version by striking out “dispensés” and substituting “four- nis”; (

c) in paragraph h.2) of the French version by striking out “dispensés” and substituting “four- nis”; (

d) by repealing paragraph (

k) and substitut- ing the following: (

k) to appoint medical practitioners, oral and maxillofacial surgeons and other health profes- sionals with the duty and power to examine and obtain information from the clinical and other re- gional health authority records, reports and ac- counts of patients who are receiving or who have received entitled services, (

e) in paragraph (k.1) by striking out “and other health professionals” and substituting “, oral and maxillofacial surgeons and other health professionals”. 3

Section 5 of the Act is amended by striking out “hospital corporation” wherever it appears and substituting “regional health authority”. 4 Paragraph 9(1)(

c) of the Act is amended by striking out “hospital corporations” and substitut- ing “regional health authorities”. 5

Section 10.01 of the French version of the Act is amended by striking out “dispensés” and substi- tuting “fournis”; 2 L’article 4 de la Loi est modifié

k) nommer des médecins, des chirurgiens bucco-dentaires et maxillo-faciaux et autres pro- fessionnels de la santé qui sont chargés et ont le pouvoir d’étudier et d’obtenir des renseigne- ments à partir des dossiers cliniques, et autres dossiers, rapports et comptes de la régie régio- nale de la santé sur les malades qui reçoivent ou ont reçu des services assurés,

e) à l’alinéa k.1), par la suppression de « et autres professionnels de la santé» et son rem- placement par « , chirurgiens bucco-dentaires et maxillo-faciaux et autres professionnels de la santé ». 3 L’article 5 de la Loi est modifié par la suppres- sion de « corporation hospitalière » là où il se trouve et son remplacement par « régie régionale de la santé ». 4 L’alinéa 9(1)

c) de la Loi est modifié par la sup- pression de « corporations hospitalières » et son remplacement par « régies régionales de la santé ». 5 L’article 10.01 de la version française de la Loi est modifié par la suppression de « dispensés » et son remplacement par «f o u r n i s».

b) to approve hospital corporations for the purposes of this Act in accordance with the regulations, (

b) For reasons of consistency of vocabulary, a word is changed in the French version. (

c) The amendment is consequential on the amendment made in paragraph 2(

b) of this amending Act. (

d) The existing provision is as follows: 4 The Minister may take such steps as he deems necessary for the following purposes:… (

k) to appoint medical practitioners and other health pro- fessionals with the duty and power to examine and obtain in- formation from the clinical and other regional health author- ity records, reports and accounts of patients who are receiving or who have received entitled services, (

e) The existing provision is as follows: 4 The Minister may take such steps as he deems necessary for the following purposes:… (k.1) to appoint medical practitioners and other health pro- fessionals with the duty and power to examine and obtain in- formation from the clinical and other records, reports and ac- counts of patients who are receiving or who have received entitled services from hospitals and other facilities outside New Brunswick,

Section 3 The existing provision is as follows: 5 Neither Her Majesty the Queen in right of the Province nor the Minister is liable for any act or omission of any hospital cor- poration official, any person on the medical staff or nursing staff of a hospital corporation or any employee or agent of a hospital corporation. Article 3 La disposition actuelle se lit comme suit : 5 Ni Sa Majesté la Reine du chef de la province ni le Ministre ne sont responsables des actes ou omissions d’un dirigeant d’une corporation hospitalière, d’un membre du personnel médical ou infirmier d’une corporation hospitalière, d’un employé ou d’un représentant d’une corporation hospitalière.

c) approving hospital corporations for the purposes of the hospital services plan;

Section 5 The amendment is consequential on the amendment made in paragraph 2(

b) of this amending Act.

Section 6 Commencement provision.
