Section of the Revenue Administration Act, chap- ter R- 10.22 of the Acts of New Brunswick, 1983, is amended L’article de la

Loi sur l’administration du reve- nu,

chapitre R-10.22 des Lois du Nouveau-Brunswick de 1983, est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 38(1) The Minister may refund any overpayment made on account of a tax if an application for the refund is made by the person who made the overpayment within three years from the day on which the overpayment was made, subject to any other time limit for the application estab- lished in or under a revenue Act. 38(1) Le Ministre peut rembourser tout paiement en trop effectué au

titre d’une taxe, si demande en est présentée dans les trois ans du paiement par la personne qui l’a ef- fectué, sous réserve de toute date limite de dépôt de la de- mande fixée dans une loi fiscale ou en vertu de celle-ci. (

b) by repealing subsection (2) and substituting the following:

b) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 38(2) No action shall be brought to recover the amount of an overpayment referred to in subsection (1) or any part of the overpayment after the expiration of three years from the day on which the overpayment was made. 38(2) L’action en recouvrement du montant du paie- ment en trop visé au paragraphe (1) ou de toute

partie de celui-ci se prescrit par trois ans à compter de la date de ce paiement. 2 This Act comes into force on January 1, 2013. 2 La présente loi entre en vigueur le 1er janvier 2013. 1
