1 Bill 45 BILL 45 2025 CRITICAL INFRASTRUCTURE DEFENCE AMENDMENT ACT, 2025 ( A s s e n t e d t o , 2 0 2 5 ) HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Amends SA 2020 cC-32.7 1 The Critical Infrastructure Defence Act is amended by this Act. 2

Section 1(1)(

a) is amended (

a) by adding the following after subclause (ii): (ii.1) all land in Alberta within 2 km of the border with the United States of America; (

b) by adding the following after subclause (viii): (viii.1) a facility (

A) as defined in the Technology Innovation and Emissions Reduction Regulation (AR 133/2019) at which at least one of the following activities occurs: (

I) extracting, processing or producing bitumen; (II) upgrading or refining bitumen; (III) extracting, processi ng or producing crude oil; (IV) extracting or processing natural gas or natural gas condensates;

chapter C-32.7 of the Statutes of Alberta, 2020. 2

Section 1(1)(

a) presently reads in part: 1(1) In this Act, (a) “essential infrastructure” means any of the following:

V) compression of natural gas for processing or fu rther processing, and (

B) at which production and specified gas emissions records for the facility are retained; (viii.2) the head or principal office, in Alberta, of a person responsible for a facility described in subclause (viii.1)(A); 3 The following is added after

section 1: Government of Canada bound 1.1 This Act binds the Government of Canada.
