B.C. Reg. 36/2009 , deposited March 2, 2009, pursuant to the CHILD, FAMILY AND COMMUNITY SERVICE ACT [Section 103]. Order in Council 89/2009, approved and ordered February 27, 2009.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, effective on the date

section 3 (1) of the Tsawwassen First Nation Final Agreement Act , S.B.C. 2007, c. 39 comes into force, the Child, Family and Community Service Regulation, B.C. Reg. 527/95, is amended as set out in the attached Schedule.

Schedule

Section 8 (2) of the Child, Family and Community Service Regulation, B.C. Reg. 527/95, is amended by repealing paragraphs (

g) and (

i) and substituting the following:

(

g) in the case of an aboriginal child other than a treaty first nation child or a Nisg a 'a child, the name of the child's Indian band or aboriginal community, in the case of a treaty

first nation child, the name of the child's treaty first nation and, in the case of a Nisg a 'a child, the Nisg a 'a Lisims Government;

(

i) in the case of an aboriginal child other than a treaty first nation child or a Nisg a 'a child, the involvement of the child's Indian band or aboriginal community, in the case of a treaty first nation child, the involvement of the child's treaty first nation and, in the case of a Nisg a 'a child, the involvement of the Nisg a 'a Lisims Government, in the development of the plan of care, including its views, if any, on the plan; .

Section 12 is amended by adding the following subsection:

(2.1) The designated representative of a treaty first nation listed in Column 1 of

Schedule 1B is a person who holds the position listed opposite in Column

Section 25 (

c) is amended

(

a) by striking out " or " at the end of subparagraph (ii) and by adding the following subparagraph:

(ii.1) if the child is a treaty first nation child, a representative of the treaty first nation, and , and

(

b) in subparagraph (iii) by striking out " if neither subparagraph (

i) nor (ii) applies, " and substituting " in any other case, ".

Schedule 1 is amended by repealing the following row:
