An Act to Amend the Municipalities Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Municipalities Act,

chapter M-22 of the Revised Statutes, 1973, is amended by adding the fol- lowing definition in alphabetical order: “geophysical exploration” means any investigation of the subsurface of the land and includes (

a) seismic operations, (

b) gravimetric operations, (

c) magnetic operations, (

d) electrical operations, (

e) geochemical operations, (

f) test drilling, and (

g) any other operation employed to determine geo- logic or other subsurface conditions; PROJET DE LOI Loi modifiant la

b) les opérations de prospection gravimétrique;

c) les opérations de prospection magnétique;

d) les opérations de prospection électrique;

e) les opérations de prospection géochimique;

f) les forages d’essai; et

g) toute autre méthode employée pour déterminer la structure géologique ou autre du sous-sol; 2 Projet de loi Loi modifiant la

Loi sur les municipalités The Act is amended by adding after subsection 25(8) the following: 25.1(1) Where twenty-five or more residents of a local service district, or any area within a local service district, who are qualified to vote under the Elections Act, petition the Minister to allow for a meeting to consider consent for geophysical exploration within the local service district or any area within a local service district, the Minister shall within thirty days call a meeting as prescribed by regula- tion of those residents who, in the opinion of the Minister, are most affected by the proposal and are qualified to vote under the Elections Act. 25.1(2) Where at the meeting held under subsection (1) at least (

a) fifty people, or (

b) thirty percent of the people, who are eligible under subsection (1) to attend the meet- ing, whichever is the lesser, are in attendance, and a ma- jority of those in attendance pass a resolution to deny con- sent for geophysical exploration within that local service district or any area within the local service district, this resolution is deemed to have the force and effect of a mu- nicipal denial of consent under the Oil and Natural Gas Act and regulations. 2 La Loi est modifiée par adjonction après le para- graphe 25(8) de ce qui suit : 25.1(1) Lorsque vingt-cinq résidents au moins d’un dis- trict de services locaux ou d’une région qui y est située, habiles à voter en vertu de la Loi électorale, présentent au Ministre une requête visant la tenue d’une assemblée pour débattre du consentement à la prospection géophysique dans ce district ou cette région, le Ministre doit convo- quer, dans un délai de trente jours et de la manière pres- crite par règlement, les résidents qui, de l’avis du Mi- nistre, sont les plus concernés par la proposition et qui ont droit de vote en vertu de la Loi électorale. 25.1(2) Lorsque, à l’assemblée tenue en application du paragraphe (1), au moins

a) cinquante personnes; ou

b) trente pour cent des personnes admissibles à cette assemblée en vertu du paragraphe (1), le nombre de personnes le moins élevé étant à retenir, sont présentes et que, par résolution adoptée à la majorité, les participants refusent de consentir à la prospection géophy- sique dans ce district ou cette région, la résolution a même valeur et effet que le refus d’une municipalité d’accorder son consentement sous le régime de la

Loi sur le pétrole et le gaz naturel et ses règlements d’application.
