B.C. Reg. 366/2008 , deposited December 8, 2008, pursuant to the WORKERS COMPENSATION ACT [Section 25.2 (2)]. Resolution of the Board of Directors dated December 2, 2008.

WHEREAS sections 25 and 25.2 of the Workers Compensation Act ("Act") requires the Board to determine, as of January 1, 2009, a percentage change by comparing the Consumer Price Index for October 2008 with the Consumer Price Index for October 2007 and by applying that percentage change to adjust those periodic payments of compensation referred to in

section 25 (3), and to adjust dollar amounts in the Act referred to in

section 25.2 (1);

AND

WHEREAS the Board is advised that the Consumer Price Index for October 2007 was 111.6 and for October 2008 was 114.5, giving a percentage change of 2.598566 percent, and subtracting 1% gives a percentage change of 1.598566 percent;

AND

WHEREAS

section 25 (2) requires that the percentage resulting from calculations made under

section 25 (1), for purposes of

section 25 (3), must not be greater that 4% or less than 0%;

THE BOARD HEREBY DETERMINES THAT B.C. Reg. 409/2007 shall be repealed as of January 1, 2009;

AND THAT the percentage change applicable under

section 25 (1) (

b) is 1.598566 percent;

AND THAT all periodic payments of compensation described in

section 25 (3) shall be adjusted by applying the percentage change of 1.598566 as of January 1, 2009;

AND THAT the percentage change applicable under

section 25.2 (1) is 2.598566 percent;

AND THAT all dollar amounts referred to in

section 25.2 (1) of the Act shall be adjusted by applying the percentage change of 2.598566 as of January 1, 2009, as follows:
