SERVICE DOGS QUALIFICATIONS AMENDMENT REGULATION

1 The Service Dogs Qualifications Regulation

(AR 197/2008) is amended by this Regulation.

Section 2 is amended by striking out "March 31, 2015" and

substituting "March 31, 2017".

Alberta Regulation 35/2015

Marketing of Agricultural Products Act

ALBERTA VEGETABLE GROWERS (PROCESSING) PRODUCTION AND

MARKETING AMENDMENT REGULATION

For information only: Made by the Alberta Pulse Growers Commission on

December 16, 2014 and approved by the Agricultural Products Marketing Council on

February 23, 2015 pursuant to sections 26 and 27 of the Marketing of Agricultural

Products Act.

1 The Alberta Vegetable Growers (Processing) Production

and Marketing Regulation (AR 160/2007) is amended by this

Regulation.

2 The title is amended by striking out "PRODUCTION

AND".

Section 1(1) is amended by repealing clauses (a), (b), and

(e).

Section 6 is amended by adding "the year of" after

"following".

5 The following is added after

section 14:

Expiry of licence

14.1 A processor's licence expires on March 31 following the year

of its issue.

Section 20 is amended by adding the following after

subsection (2):

(3) Notwithstanding subsection (1), an increase in the service charge

above the rate referred to in subsection (1) shall not be effective until

it has been approved by a vote of the licensed producers at an annual

general meeting or a special general meeting.

Section 23 is amended

(

a) In subsection (1) by striking out "orders and directions"

and substituting "administrative orders and directives";

(

b) In subsection (2) by striking out "order or direction"

and substituting "administrative order or directive".

Section 24 is amended by striking out ", licence fees".

Section 25 is repealed and the following is substituted:

Prohibitions

25(1) No processor shall enter into a contract for the purchase of the

regulated product or buy the regulated product produced by any

person in the area of Alberta to which the Plan applies unless the

processor has a valid processor's licence.

(2) No licensed processor shall enter into a contract for the purchase

of the regulated product with any person or buy the regulated

produce from any person in the area of Alberta to which the Plan

applies unless the person is a registrant.

(3) No person shall produce or market the regulated product

produced in the area of Alberta to which the Plan applies unless that

person holds a producer's licence and a contract with a licensed

processor.

(4) No licensed producer shall sell, offer for sale or deliver the

regulated product produced in the Area of Alberta to which the Plan

applies to any person other than a licensed processor.

(5) No person shall sell, buy, deliver or receive, or offer to sell, buy,

deliver or receive the regulated product produced in the area of

Alberta to which the Plan applies except in accordance with this

Regulation or on terms other than those negotiated by the Board and

the licensed processors or fixed by an arbitrator pursuant to

regulations made by the Council.

Section 28 is repealed.

Section 29 is amended by striking out "June 30, 2015"

and substituting "November 30, 2020".

12 The following provisions are amended by striking out

"the Act or an order or direction of the Council or the Board"

wherever it occurs and substituting "the Act, a direction of the

Council or an administrative order or directive of the Board":

section 11(1)(b);

section 11(2)(e);

section 17(1).

25 Transcriptions of proceedings when required by a trial judge

26 The fee for any transcription or work required to be done by an

official court reporter that is not specified by this tariff is to be fixed

by analogy.

3 This Regulation comes into force on the coming into

force of

section 12(4) and (5) of the Statutes Amendment

Act, 2013 (No. 2).

1 The Transcript Fees and Format Regulation

(AR 167/2010) is amended by this Regulation.

Section 1(2) is repealed.

Section 4 is amended by striking out "November 1, 2015"

and substituting "November 1, 2020".

4 This Regulation comes into force on the coming into

force of

section 12(4) and (5) of the Statutes Amendment

Act, 2013 (No. 2).

CAPITAL REGION BOARD AMENDMENT REGULATION

1 The Capital Region Board Regulation (AR 38/2012) is

amended by this Regulation.

Section 6 is repealed and the following is substituted:

Powers and duties of Board

Section 602.08 of the Act applies with any necessary

modifications in respect of the Capital Region Board as if it were a

regional services commission.

3 Sections 7, 8, 9, 13, 14, 17, 18 and 30 are repealed.

Human Services.
