Alberta Regulation 185/2020

Land Titles Act

NAME SEARCH AMENDMENT REGULATION

For information only: Made by the Lieutenant Governor in Council (O.C. 297/2020)

on October 7, 2020 pursuant to

section 213 of the Land Titles Act.

1 The Name Search Regulation (AR 207/99) is amended by

this Regulation.

2 The following is added after

section 2:

Court order authorizing search

2.1 An order of a court referred to in

section 2(

e) may include any

of the following:

(

a) the legal name or legal names of the person or persons who

are authorized to request the name search;

(

b) the legal name or legal names to be searched;

(

c) the period of time, if any, during which the search may be

conducted;

(

d) any further conditions that the court considers appropriate.

Section 3, as extended by the Regulations Expiry Date

Extension Regulation (AR 47/2020), is amended by striking

out "June 1, 2020" and substituting "May 31, 2025".

Real Estate Act

REAL ESTATE EXEMPTION

AMENDMENT REGULATION

section 84 of the Real Estate Act.

1 The Real Estate Exemption Regulation (AR 111/96) is

amended by this Regulation.

2 The following is added after

section 2:

Condominium management services

2.1(1) In this section, "condominium management service" means

the exercising of a power or the performing of a duty of a

condominium corporation on behalf of the condominium

corporation, including, but not limited to,

(

a) collecting, holding or disbursing, or attempting to collect,

hold or disburse, contributions levied by the condominium

corporation or other amounts levied by or due to the

corporation under the Condominium Property Act,

(

b) enforcing the bylaws or rules of the corporation,

(

c) negotiating or entering into contracts on behalf of the

corporation, and

(

d) supervising employees or contractors hired or engaged by the

corporation,

but does not include any activity excluded by the Act, the

Condominium Property Act, or the regulations under either Act.

(2) Subject to subsections (3) to (7), a person who holds an

authorization under the class of real estate broker known as a

temporary condominium manager authorization and a person who is

engaged in the business of providing a condominium management

service, including a person who holds a licence to provide a

condominium management service, is exempt from the provisions of

the Act.

(3) A person who holds a licence or authorization described in

subsection (2) may, if otherwise eligible,

(

a) vote in an election held in accordance with

section 7.1(2)(

b) of the Act as enacted by

section 10 of the Real Estate

Amendment Act, 2020, and

(

b) serve as a licensee member of an Industry Council if elected

by the licensees of that industry, as contemplated by

section

7.1(2)(

b) of the Act as enacted by

section 10 of the Real

Estate Amendment Act, 2020, in which case

section 7.1(3) to

(8) and (10) of the Act as enacted by

section 10 of the Real

Estate Amendment Act, 2020 apply to the person as a

member of the Industry Council.

(4) A person referred to in subsection (2) who has been elected to an

Industry Council in accordance with

section 7.1(2)(

b) of the Act as

enacted by

section 10 of the Real Estate Amendment Act, 2020 may

serve as a member of the Board as contemplated by

section 6(1)(

b) of the Act as enacted by

section 8 of the Real Estate Amendment Act,

2020, in which case

section 6(2), (3), (4), (7) and (9) of the Act as

enacted by

section 8 of the Real Estate Amendment Act, 2020 apply

to the person as a member of the Board.

(5) If an Industry Council establishes a rule under

section 7.2(2) of

the Act as enacted by

section 10 of the Real Estate Amendment Act,

2020 and that rule specifies that it applies to a person referred to in

subsection (2), the rule will apply to the person according to the

terms of the rule.

(6) Section 9 of the Act as enacted by

section 13 of the Real Estate

Amendment Act, 2020 applies to a person referred to in subsection

(2) if the person is a member of an Industry Council or the Board.

(7) Despite subsection (2), the Act applies to a person referred to in

that subsection if the person otherwise holds an authorization or

licence issued under the Act, but the Act does not apply to the person

with respect to the person providing a condominium management

service or a service authorized by a temporary condominium

management authorization.

(8) This

section is repealed on December 1, 2021.

1 The Regional Airports Authorities Regulation (AR 149/90)

is amended by this Regulation.

Section 144.1, as extended by the Regulations Expiry

Date Extension Regulation (AR 47/2020), is amended by

striking out "June 30, 2020" and substituting "June 30, 2025".

Local Authorities Capital Financing Act

LOCAL AUTHORITIES CAPITAL

FINANCING REGULATION

section 6 of the Local Authorities Capital Financing

Act.

Maximum outstanding loans

1 For the purpose of

section 3 of the Act, the total principal amount

of all outstanding loans made by the Minister under the Act shall not

exceed $18 000 000 000.

Coming into force

2 This Regulation has effect on the coming into force of

section 6 of

the Local Authorities Capital Financing Act.

ALBERTA CAPITAL FINANCE AUTHORITY

ACT REPEAL REGULATIONS

section 35 of the Alberta Capital Finance

Authority Act.

1 The Alberta Capital Finance Authority Regulation

(AR 258/2006) is repealed.

2 The Allotment of Shares Regulation (AR 15/2005) is

repealed.

3 This Regulation has effect on the coming into force of

section 11 of the Local Authorities Capital Financing Act.

BILLING REGULATION, 2003

AMENDMENT REGULATION

Filed: October 15, 2020

For information only: Made by the Minister of Energy (M.O. 058/2020) on October

9, 2020 pursuant to sections 108 and 115 of the Electric Utilities Act.

1 The Billing Regulation, 2003 (AR 159/2003) is amended

by this Regulation.

Section 6 is amended by striking out "April 30, 2020" and

substituting "April 30, 2025".
