chapter P-9.4 of the Acts of New Brunswick, 1979, is amended by adding after

section 2 the following: 1 La

chapitre P-9.4 des Lois du Nouveau-Brunswick de 1979, est modifiée par l’adjonction de ce qui suit après l’article 2 : 2.1 An advisory council is established to advise the Min- ister on any question submitted to it with respect to the eradication of potato diseases in the Province. 2.1 Est constitué un conseil consultatif chargé de con- seiller le Ministre sur toute question dont il est saisit rela- tivement à l’éradication des maladies des pommes de terre dans la province. 2.2 After considering the advice of the advisory council, the Minister may, by order, determine the maximum ac- ceptable levels of PVY for all seed potatoes that are tested for disease in accordance with the regulations. 2.2 Après avoir tenu compte de l’avis du conseil con- sultatif, le Ministre peut, par arrêté, fixer les niveaux de PVY maximaux acceptables pour les pommes de terre de semence qui sont examinées aux fins de dépistage confor- mément aux règlements. 2.3 The Regulations Act does not apply to an order made by the Minister under

section 2.2. 2.3 La

Section 24 of the Act is repealed and the following is substituted: 3 L’article 24 de la Loi est abrogé et remplacé par ce qui suit : 24 A person who violates or fails to comply with a pro- vision of this Act or the regulations commits an offence and is liable, on conviction, to a fine of not less than $1,000 and not more than $20,000. 24 Quiconque contrevient ou omet de se conformer à une disposition de la présente loi ou des règlements com- met une infraction et est passible, sur déclaration de cul- pabilité, d’une amende minimale de 1 000 $ et maximale de 20 000 $. 4

a) in subsection (1) by striking out “25.8(1) or”;
