An Act to Amend the Fish and Wildlife Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 Subsection 92(2) of the Fish and Wildlife Act,

chapter F-14.1 of the Acts of New Brunswick, 1980, is amended by striking out “and 99” and substituting “, 99 and 99.1”. 2 The Act is amended by adding the following af- ter

section 99: 99.1(1) Where the Minister is satisfied that a per- son convicted of an offence under subsection 5.3(1) of the Clean Environment Act , subsection 12(1) or 15(1) of the Clean Water Act or subsection 6(2) of the Clean Air Act committed the offence within a protected natural area established under the Pro- tected Natural Areas Act, or where a person is con- victed of an offence under paragraph 11(

a) or (

b) or clause 12(a)(xiii)(A), (

B) or (

C) of the Protected Natural Areas Act, every licence and permit held by the person under this Act shall be cancelled by the Minister effective from the date of conviction, and the person shall not be entitled to obtain or apply for PROJET DE LOI 15 Loi modifiant la

Loi sur les zones naturelles protégées, ou lorsqu’une personne est déclarée cou- pable d’une infraction à l’alinéa 11a) ou

b) ou à la division 12a)(xiii)(A), (

B) ou (

C) de la

Loi sur les zones naturelles protégées , tout permis et toute li- cence dont elle est titulaire en vertu de la présente

Loi sur la pêche sportive et la chasse a licence or permit issued under this Act or the reg- ulations (

a) for a period of one year after the date of the conviction, if the person was fined less than five thousand dollars in respect of the offence, and (

b) for a period of five years after the date of the conviction, if the person was fined five thou- sand dollars or more in respect of the offence. 99.1(2) Where the Minister has cancelled a li- cence or permit under subsection (1) and the person in respect of whom the cancellation was made is convicted of an offence under the Protected Natural Areas Act or the regulations under that Act (

a) during the period referred to in paragraph (1)(a), the period of cancellation shall be ex- tended by, and the person shall not be entitled to obtain or apply for a licence or permit issued un- der this Act or the regulations for, an additional period of five years, and (

b) during the period referred to in paragraph (1)(b), the period of cancellation shall be ex- tended by, and the person shall not be entitled to obtain or apply for a licence or permit issued un- der this Act or the regulations for, the lifetime of the person. 99.1(3) The Director of Fish and Wildlife Law Enforcement shall cause the person referred to in subsection (1) or (2) to be notified of the disentitle- ment under those subsections. 99.1(4) Where ten years have elapsed from the date of the second conviction of a person referred to in paragraph (2)(b), loi sont annulés par le Ministre à compter de la date de la déclaration de culpabilité et la personne n’a pas le droit d’obtenir ni de demander que lui soit dé- livré un permis ou une licence en vertu de la pré- sente loi ou des règlements

a) pendant la période visée à l’alinéa (1)a), une période de cinq ans s’ajoute à la période initiale et la personne n’a pas le droit d’obtenir ni de demander que lui soit délivré un permis ou une licence en vertu de la présente loi ou des règle- ments pendant la période d’annulation supplé- mentaire, et

b) pendant la période visée à l’alinéa (1)b), la période d’annulation est prolongée au reste de la vie de la personne et elle n’a plus le droit d’obte- nir ni de demander que lui soit délivré un permis ou une licence en vertu de la présente loi ou des règlements pour le reste de sa vie. 99.1(3)

Le directeur de l’application de la loi en matière de pêche sportive et de chasse doit faire avi- ser la personne visée au paragraphe (1) ou (2) de la perte de son droit en vertu de ces paragraphes. 99.1(4) Lorsque dix ans se sont écoulés après la date de la deuxième déclaration de culpabilité de la personne visée à l’alinéa (2)b),

a) the person whose licence or permit is can- celled may apply to the Minister requesting a re- view of the circumstances of the case, and (

b) the Minister may, on receipt of the applica- tion, review the circumstances of the case and re- move the bar on future applications imposed by subsection (2). 3

Section 100 of the Act is amended by striking out “or 98.1” and substituting “, 98.1 or 99.1”. 4 Subsection 102(1) of the Act is amended by striking out “or 98.1” and substituting “, 98.1 or 99.1”. 5 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

An Act to Amend the Fish and Wildlife Act Bill 15 EXPLANATORY NOTES

Section 1 The existing provision is as follows: 92(2) Subject to sections 95.1, 95.2, 96, 96.1, 97, 98 and 99 the Minister may reinstate any licence cancelled under this Act.

Section 2 New provisions.

Section 3 The existing provision is as follows: 100 For the purposes of

section 95.2, 97, 98 or 98.1, where a person has been convicted of more than one offence arising out of a single incident such convictions shall be counted as a con- viction for one offence.

Section 4 The existing provision is as follows: 102(1) Where a licence has been cancelled under

section 95.1, 95.2, 96, 97, 98 or 98.1, the Director of Fish and Wildlife Law Enforcement shall cause the cancellation notice to be served on the person.

Section 5 Commencement provision. NOTES EXPLICATIVES

Article 3 La disposition actuelle se lit comme suit : 100 Aux fins d’application des articles 95.2, 97, 98 ou 98.1, lorsqu’une personne a été déclarée coupable de plus d’une in- fraction à la suite d’un seul incident, une seule déclaration de culpabilité est prononcée et il n’est compté qu’une seule infrac- tion.

Article 4 La disposition actuelle se lit comme suit : 102(1) Lorsqu’un permis a été annulé en vertu des articles 95.1, 95.2, 96, 97, 98 ou 98.1, le directeur de l’application de la loi en matière de pêche sportive et de chasse doit faire signifier un avis d’annulation à l’intéressé.

Article 5 Entrée en vigueur.
