EXPLANATORY NOTE NOTE EXPLICATIVE This Bill prohibits a municipality from using phosphorus-based substances to control the leaching of lead into the water pipes of a municipal water distribution system. BILL 216 PROJET DE LOI 216 THE MUNICIPAL WATER SYSTEM PHOSPHORUS CONTROL ACT

LOI SUR LA RÉDUCTION DU PHOSPHORE DANS LES RÉSEAUX MUNICIPAUX D'ALIMENTATION EN EAU (Assented to ) (Date de sanction : ) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows: SA MAJESTÉ, sur l'avis et avec le consentement de l'Assemblée législative du Manitoba, édicte : Phosphorus-based lead control products prohibited 1 A municipality must not (

a) use a phosphorus-based substance; or (

b) cause or permit another person to use a phosphorus-based substance; to control the leaching of lead into water pipes in the municipal water distribution system. section 1 is guilty of an offence and is liable on

summary conviction, (

a) for a first offence, to a fine of not more than $500,000; and (

2 Continuing offence 3 If a contravention of this Act continues for more than one day, the municipality is guilty of a separate offence for each day the contravention continues.
