An Act to Amend the Trespass Act Loi modifiant la

Section 1 of the Trespass Act,

chapter 117 of the Revised Statutes, 2012, is amended 1 L’article 1 de la

a) by repealing the definition “authorized person” and substituting the following:

a) par l’abrogation de la définition de « personne autorisée » et son remplacement par ce qui suit : “authorized person” means an occupier or owner of a premises and an agent of the occupier or owner. (per‐ sonne autorisé

b) by repealing the definition “occupier” and sub‐ stituting the following:

a) a person who is in possession of premises,

Section 2 of the Act is amended 2 L’article 2 de la Loi est modifié (

a) by renumbering the

section as subsection 2(1);

Section 3 of the Act is amended 4 L’article 3 de la Loi est modifié (

a) in subsection (1)

i) by repealing the portion preceding para ‐ graph (

a) and substituting the following: (

Trespass or prohibited activity on lawn, garden or enclosed premises Intrusion ou exercice d’une activité interdite sur une pelouse ou dans un jardin ou un lieu fermé 4.1(1) No person shall trespass by motor vehicle or other means or engage in an activity, whether or not the person has had notice from an authorized person not to trespass or engage in the activity, on the following prem‐ ises: 4.1(1) Qu’un avis d’interdiction d’intrusion ou d’inter ‐ diction d’exercer une activité quelconque lui ait été don ‐ né ou non par une personne autorisée, nul ne peut faire ni intrusion, notamment au moyen d’un véhicule à mo ‐ teur, ni exercer l’activité en question, dans les lieux sui ‐ vants : (

a) a lawn or garden; or

a) une pelouse ou un jardin; (

b) a premises that is enclosed

b) des lieux fermés qui sont : (

i) by a fence, a natural boundary or a combina ‐ tion of a fence and a natural boundary, or (

i) soit entourés d’une clôture, d’une limite natu ‐ relle ou d’une combinaison des deux, (ii) in a manner that indicates the intention of the occupier or owner of the premises to keep persons off the premises. Section 7 of the Act is amended 6 L’article 7 de la Loi est modifié (

Section 9 of the Act is repealed and the following is substituted: 8 L’article 9 de la Loi est abrogé et remplacé par ce qui suit : 9 An occupier owes no duty of care to a trespasser, in ‐ cluding a trespasser who drives a motor vehicle, is a pas ‐ senger in a motor vehicle or is towed by a motor vehicle, on the premises of the occupier except the duty not to 9 L’occupant n’est tenu, dans les lieux qu’il occupe, à aucun devoir de diligence à l’égard d’un intrus, notam ‐ ment celui qui conduit un véhicule à moteur ou qui en est le passager ou encore qui est pris en remorque par un tel véhicule, exception faite du devoir : (

Section 10 of the Act is amended 9 L’article 10 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem ‐ placement par ce qui suit : 10(1) An occupier or owner of a premises may require any person the occupier or owner believes on reasonable grounds to have committed an offence under this Act to identify themselves. 10(1) L’occupant ou le propriétaire de lieux peut exi ‐ ger de toute personne qu’elle décline son identité s’il a des motifs raisonnables de croire qu’elle a commis une infraction à la présente loi. (

b) by repealing subsection (2) and substituting the following:

b) par l’abrogation du paragraphe (2) et son rem ‐ placement par ce qui suit : 10(2) If a person referred to in subsection (1) fails or refuses to identify themselves or if there are reasonable grounds to believe that the identification given is false, the occupier or owner may arrest the person without warrant to establish the person’s identity for purposes of a prosecution under this Act. 10(2) Lorsque la personne visée au paragraphe (1) omet ou refuse de décliner son identité ou s’il a des mo ‐ tifs raisonnables de croire que l’identité qu’elle a dé ‐ clinée est fausse, l’occupant ou le propriétaire peut pro ‐ céder à son arrestation sans mandat afin d’établir son identité aux fins d’une poursuite intentée en vertu de la présente loi. 10 The Act is amended by adding after

section 10 the following: 10 La Loi est modifiée par l’adjonction de ce qui suit après l’article 10 : Arrest without warrant by peace officer Arrestation sans mandat par un agent de la paix 10.1(1) A peace officer may arrest without warrant any person found on a premises if the peace officer has reasonable grounds to believe that the person is commit ‐ ting an offence under this Act. 10.1(1) Un agent de la paix peut procéder à l’arresta ‐ tion sans mandat d’une personne qui se trouve dans tous lieux s’il a des motifs raisonnables de croire qu’elle commet une infraction à la présente loi. 10.1(2) A peace officer may arrest a person without warrant if the peace officer has reasonable grounds to believe that the person has committed an offence under this Act and has recently departed from the premises and 10.1(2) L’agent de la paix peut procéder à l’arrestation sans mandat d’une personne si, à la fois, il a des motifs raisonnables de croire qu’elle a commis une infraction à la présente loi et a quitté les lieux depuis peu et :

a) the person fails or refuses to identify themselves to the peace officer, or

b) the peace officer has reasonable grounds to be ‐ lieve that the identification given by the person is false.

Section 11 of the Act is amended 11 L’article 11 de la Loi est modifié (

a) in subsection (1) by striking out “he or she” and substituting “the peace officer”;

a) had title to or an interest in the premises that en ‐ titled them to enter on the premises or to do the act complained of, or
