OIC Text: The Governor in Council on the report and recommendation of the President of the Executive Council dated March 26, 2008, and pursuant to Sections 2A, 3 and 4 of
Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, and all other authority in her vested, is pleased to, effective April 1, 2008: (
a) create a Department of Labour and Workforce Development and prescribe the name of the department to be the Department of Labour and Workforce Development; (
b) direct that the Department of Labour and Workforce Development shall be presided over by the Minister of Labour and Workforce Development, who has the supervision, direction and control of all affairs and matters relating to the Department and who shall supervise the performance of the functions of the Department; (
c) direct that all affairs and matters pertaining to labour services, labour standards, occupational health and safety, pension services, public safety, the workers' advisers program, liquor control, film licensing and classification, amusement control and gaming control which have heretofore been assigned by or under any Act of the Legislature to the Department of Environment and Labour or the Minister of Environment and Labour are assigned to the Department of Labour and Workforce Development or the Minister of Labour and Workforce Development as the case may be; (
d) direct that all affairs and matters relating to apprenticeship, workplace education, the Nova Scotia School for Adult Learning, labour market development, labour mobility and credential recognition which have heretofore been assigned by or under any Act of the Legislature to the Department of Education or the Minister of Education are assigned to the Department of Labour and Workforce Development or the Minister of Labour and Workforce Development as the case may be; (
e) direct that the Department of Environment and Labour be renamed the Department of Environment and shall be presided over by the Minister of Environment; (
f) direct that all affairs and matters relating to climate-change which have heretofore been assigned by or under any Act of the Legislature to the Department of Energy or the Minister of Energy are assigned to the Department of Environment or the Minister of Environment as the case may be; and (
g) direct that a reference in any Act of the Legislature or in any rule, order, regulation, bylaw, ordinance or proceeding, or in any document whatsoever, to a Department or to the Minister or Deputy Minister of that Department, the name of which has been changed by this Order or to which affairs and matters have been transferred by this Order, whether the reference is by official name or otherwise, shall with respect to any subsequent transaction, matter or thing be held and construed to be a reference to the Department or to the Minister or Deputy Minister of that Department to which a name has been changed or to which the affairs and matters have been transferred, as the case may be.
