On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Fees Regulation, B.C. Reg. 244/2011, is amended as set out in the attached schedule.

Schedule

Section 2 of the Fees Regulation, B.C. Reg. 244/2011, is amended

(

a) by renumbering the

section as

section 2 (1),

(

b) in subsection (1) by striking out " certification fees for the purposes of

section 30 (1) (b) [issuance of certificate] of the Act: " and substituting " fees for the purposes of

section 30 (1) (b) [issuance of certificate] of the Act that must accompany an applicant's application for a certificate of qualification or an independent school teaching certificate: ",

(

c) in subsection (1) (

c) by adding " or an independent school teaching certificate " after " applies for a certificate of qualification ", and

(

d) by adding the following subsection:

(2) The following are the prescribed fees for the purposes of

section 30 (1) (

b) of the Act that an applicant must pay when the director of certification issues a certificate of qualification or an independent school teaching certificate:

(a) $40 if the certificate of qualification or independent school teaching certificate is issued on or after December 1 and on or before May 31;

(b) $80 if the certificate of qualification or independent school teaching certificate is issued on or after June 1 and on or before November 30.

2 The following

section is added:

Fee for issuance of certificate - certificates subject to undertaking

2.1

(1) Despite

section 2 (1), the fee that must accompany an applicant's application for a certificate of qualification or an independent school teaching certificate is $100 for an applicant who

(

a) had, immediately before the coming into force of the Act, a valid and subsisting certificate of qualification under the former Act, and

(

b) was, immediately before the coming into force of the Act, subject to an undertaking according to which the person holding the certificate of qualification under the former Act agreed not to practise teaching, other than an undertaking entered into because the holder of the certificate is incompetent to carry out professional duties and responsibilities because of a physical or mental disability.

(2) In this section, "former Act" means the Teaching Profession Act , R.S.B.C. 1996, c. 449.

(3) This

section is repealed on June 30,

Section 6 is repealed and the following substituted:

Annual practice fee

6 The following are the prescribed fees for the purposes of

section 37 [annual practice fee] of the Act:

(

a) the annual practice fee is $80;

(

b) the late fee under

section 37 (2) of the Act is $30;

(

c) the additional late fee under

section 37 (3) (

b) of the Act is $30.

Section 8 is amended by repealing the Table and substituting the following:
