(25), and 3 of the Municipal Affairs Statutes Amendment Act, 2024 in force:

Municipal District of Bonnyville No. 87 to the City of Cold Lake set out in the

attached Appendix.

APPENDIX

ORDER ANNEXING LAND FROM THE MUNICIPAL DISTRICT OF

BONNYVILLE NO. 87 TO THE CITY OF COLD LAKE

1 In this Order,

(a) "annexed land" means the land described in

Schedule 1 and shown on the

sketch in

Schedule 2;

(b) "City of Cold Lake Land Use Bylaw" means City of Cold Lake Bylaw

766-LU-23 Land Use Bylaw as it read on January 1, 2024.

2 Effective October 1, 2024, the annexed land is separated from the Municipal

District of Bonnyville No. 87 and annexed to the City of Cold Lake.

3 Any tax arrears owing to the Municipal District of Bonnyville No. 87 at the end of

September 30, 2024, in respect of the annexed land and any assessable improvements

to it are transferred to and become payable to the City of Cold Lake together with any

lawful penalties and costs levied in respect of those taxes, and the City of Cold Lake

on collecting those taxes, penalties and costs must pay them to the Municipal District

of Bonnyville No. 87.

4(1) For the purpose of taxation in 2024 and in each subsequent year up to and

including 2074, the annexed land and assessable improvements to it

(

a) must be assessed on the same basis as if they had remained in the Municipal

District of Bonnyville No. 87, and

(

b) must be taxed in respect of each assessment class that applies to the annexed

land and the assessable improvements to it using

(

i) the municipal tax rate established by Municipal District of Bonnyville

No. 87, or

(ii) the municipal tax rate established by the City of Cold Lake,

whichever is lower, for property of the same assessment class.

(2) Where in 2024 or any subsequent taxation year up to and including 2074 a

portion of the annexed land

(

a) becomes a new parcel of land created

(

i) as a result of subdivision,

(ii) as a result of separation of the title by registered plan of subdivision, or

(iii) by instrument or any other method

that occurs at the request of or on behalf of the landowner,

(

b) is redesignated, at the request of or on behalf of the landowner, under the

City of Cold Lake Land Use Bylaw, to another designation, or

(

c) is connected, at the request of or on behalf of the landowner, to water or

sanitary sewer services provided by the City of Cold Lake,

subsection (1) ceases to apply at the end of that taxation year in respect of that portion

of the annexed land and the assessable improvements to it.

(3) After subsection (1) ceases to apply to a portion of the annexed land in a taxation

year, that portion of the annexed land and the assessable improvements to it must be

assessed and taxed for the purposes of property taxes in the same manner as other

property of the same assessment class in the City of Cold Lake.

(4) Notwithstanding subsection (2)(a), subsection (1) does not cease to apply to

Lot 1, Block 1, Plan 092 5400 and Lot 2, Block 1, Plan 112 2731 if an application for

subdivision to adjust the boundaries between Lot 1, Block 1, Plan 092 5400 and

Lot 2, Block 1, Plan 112 2731 is determined or deemed to be complete by the Cold

Lake Subdivision Authority in accordance with

section 653.1 of the Municipal

Government Act by July 1, 2025 or within 12 months of this Order coming into force,

whichever is later.

5(1) For the purpose of taxation in 2024, the Municipal District of Bonnyville No. 87

must assess the annexed land and the assessable improvements to it.

(2) Taxes payable for the 2024 taxation year in respect of the annexed land and any

assessable improvements to it are to be paid to the Municipal District of Bonnyville

No. 87, and the Municipal District of Bonnyville No. 87, on collecting those taxes,

must pay 25% of the taxes collected to the City of Cold Lake.

6 For the purpose of taxation in 2025 and subsequent years, the assessor for the City

of Cold Lake must assess the annexed land and the assessable improvements to it.

a. The full purchase price if it is $10,000 or less; OR

b. If the purchase price is greater than $10,000, the purchaser must

provide a non-refundable deposit in the amount of $10,000 and the

balance of the purchase price must be paid within 20 days of the sale.

excess will be refunded within a reasonable time)

8. GST will be collected on all properties subject to GST.

9. The risk of the property lies with the purchaser immediately following the

auction.

registration fees.

12. If no offer is received on a property or if the reserve bid is not met, the property

13. The municipality may, after the public auction, become the owner of any parcel

of land that is not sold at the public auction.

14. Once the property is declared sold at public auction, the previous owner has no

further right to pay the tax arrears.
