Section 2 of the Tobacco Tax Act,

chapter T-7 of the Revised Statutes, 1973, is amended 1 L’article 2 de la Loi de la taxe sur le tabac, chapi- tre T-7 des Lois révisées de 1973, est modifié (

a) in subsection (4.3) by adding after paragraph (

Section 3 of the Act is repealed and the following is substituted: 2 L’article 3 de la Loi est abrogé et remplacé par ce qui suit : 3 Every consumer of tobacco purchased at a retail sale in the Province, for the purpose of raising a revenue, shall pay to Her Majesty the Queen in right of the Prov- ince at the time of making the purchase a tax in respect of the consumption of the tobacco at the rate of 3 Tout consommateur de tabac acheté à une vente au détail dans la province doit, afin de lui procurer des fonds, payer à Sa Majesté la Reine du chef de la pro- vince, au moment où il achète ce tabac, une taxe de con- sommation sur ce tabac aux taux suivants : (

Section 18 of the Act is amended 3 L’article 18 de la Loi est modifié (

a) by repealing subsection (1.1) and substituting the following:

a) par l’abrogation du paragraphe (1.1) et son remplacement par ce qui suit : 18(1.1) Despite subsection 56(6) of the Provincial Of- fences Procedure Act, the minimum fine that may be im- posed by a judge under that Act in respect of a violation of subsection 2.2(1), (1.4), (1.5) or (1.6) is $2,000. 18(1.1) Par dérogation au paragraphe 56(6) de la

Part 2 of the Provincial Offences Procedure Act and, if applicable, under subsection (1.1) or (1.2), on a person who is con- victed of a violation of subsection 2.2(1), (1.2), (1.3) or (1.4) shall impose an additional fine on the person equal in amount to five times the tax that would be payable on the tobacco in respect of which the offence was commit- ted. 18(2) Le juge qui impose une amende en vertu de la
