section 22 of the Fuel Tax Amendment Act, 1996 provides that

section 2(

a) of that Act comes into force on Proclamation; and

WHEREAS it is expedient to proclaim

section 2(

a) of that Act in force:

NOW KNOW YE THAT by and with the advice and consent of our Executive

Council of Our Province of Alberta, by virtue of the provisions of the said

Act hereinbefore referred to and of all other power and authority

whatsoever in Us vested in that behalf, We have ordered and declared and do

b) any taxes owing to The Municipal District of Willow Creek No. 26 on

December 31, 1996 in respect of the annexed land are transferred to and

become payable to The

Town of Nanton together with any lawful penalties and costs levied in

respect of those taxes, and The Town of Nanton upon collecting those taxes,

penalties or costs must pay them to The Municipal District of Willow Creek

No. 26,

c) the assessor for The Town of Nanton must assess in 1996, for the

purposes of taxation in 1997, the annexed land and the assessable

improvements to it,

(

d) for purposes of property taxes in 1997 and subsequent years, the

annexed land and assessable improvements to it must be assessed and taxed

by The Town of Nanton on the same basis and as if they had remained within

The Municipal District of Willow Creek No. 26,

(

e) if either or both of the following occur after December 31, 1996 at the

request of, or on behalf of the landowner:

(

i) a parcel of the annexed land is the subject of a subdivision or

separation of title, whether by registered plan of subdivision, by

instrument or any other method whereby a new parcel of land, including the

residual parcel, is created,

(ii) a parcel of the annexed land is redesignated, pursuant to The

Town of Nanton Land Use By-law, to a use other than that existing on

December 31, 1996,

clause (

d) ceases to apply to the parcel of land and the assessable

improvements to it in the first complete taxation year immediately

following the taxation year in which the event or circumstance referred to

in subclause (

i) or (ii) occurs, and

(

f) after clause (

d) ceases to apply to a parcel of land in a taxation

year, the land and the assessable improvements to it must be assessed, for

the purposes of property taxes in that year, on the same basis as other

land and improvements in The Town of Nanton.

The Lieutenant Governor in Council

(

a) forms, at the beginning of October 1, 1996, a town having the name

"Cold Lake" by the amalgamation of the Town of Cold Lake and the Town of

Grand Centre and by the annexation of land from The Municipal District of

Bonnyville No. 87,

(

b) establishes that Cold Lake is composed of the land described in

Schedule 2, and

(

c) makes the order in

Schedule 1.

SCHEDULE 1

SPECIAL PROVISIONS FOR THE FORMATION OF COLD LAKE

Definitions

1. In this Schedule,

(a) "Cold Lake" means the town formed at the beginning of October 1,

1996;

(b) "old municipal authorities" means The Town of Cold Lake, The Town

of Grand Centre and The Municipal District of Bonnyville No. 87;

(c) "Minister" means the Minister of Municipal Affairs.

Transitional Provisions

2. Bylaws and resolutions of an old municipal authority continue to

apply to the territory of the old municipal authority in Cold Lake until

repealed or others are made in their place by Cold Lake.

3. The Municipal District of Bonnyville No. 87 continues to be the owner

of Block 4, Plan 3629 NY, known as the "Municipal District Park."

(1) An agreement between any of the old municipal authorities and a

person, corporation or municipality that relates to the land described in

Schedule 2 is binding on Cold Lake, as far as is practicable, as though

Cold Lake replaced the old municipal authority as a party to the agreement.

(2) Despite subsection (1), Cold Lake does not replace The Municipal

District of Bonnyville No. 87 in the agreement that exists between the

Medley Canadian Forces Base Society and The Municipal District of

Bonnyville No. 87 dated August 21, 1981, and extended by agreement on June

6, 1989.

5 A reference to any land described in

Schedule 2 in any order,

regulation, bylaw, or resolution, certificate of title, agreement or other

instrument is deemed to be a reference to Cold Lake.

6 The Municipal District of Bonnyville No. 87 shall pay $2,000,000 to

Cold Lake no later than October 31, 1996.

7 One quarter of the payment-in-lieu of taxes for that portion of the

Federal lands known as 4 Wing Cold Lake included in Cold Lake shall be paid

by The Municipal District of Bonnyville No. 87 to Cold Lake on or before

November 15, 1996.

(1) The allocation of other assets of The Municipal District of

Bonnyville No. 87 shall be resolved by negotiation between The Municipal

District of Bonnyville No. 87 and Cold Lake.

(2) If a negotiated agreement concerning the allocation of other

assets between The Municipal District of Bonnyville No. 87 and Cold Lake is

not reached prior to December 31, 1996, the Minister shall decide on the

division of the assets of The Municipal District of Bonnyville No. 87.

9 The Minister may decide any question arising over the division or

apportionment of the property, rights, assets and liabilities resulting

from the formation of Cold Lake.

10 Subject to sections 11 and 12 of this Schedule, for the 1997 and 1998

taxation bylaws, Cold Lake may set rates of taxation applying to

residential property which was located within the old municipality of The

Town of Cold Lake that are different from the rates of taxation on

residential property set for the remainder of Cold Lake.

11 For the 1997 taxation year, the rate of taxation set for residential

property which was located within the old municipality of The Town of Cold

Lake shall not be more than the 1997 rate of taxation on residential

property set for the remainder of Cold Lake plus 16%.

12 For the 1998 taxation year, the rate of taxation set for residential

property which was located within the old municipality of The Town of Cold

Lake shall not be more than the 1998 rate of taxation on residential

property set for the remainder of Cold Lake plus 8%.

13 Sections 10, 11 and 12 of this

Schedule do not apply to the rates of

taxation set for the purpose of raising funds to pay requisitions as

defined under

section 326(

a) of the Municipal Government Act.

14 The councils of The Town of Cold Lake and The Town of Grand Centre

are dissolved on the formation of Cold Lake.

15 The Minister shall appoint an Official Administrator for Cold Lake,

who has all the powers and duties of a council until the first council of

Cold Lake is sworn into office.

First General Election

16 Until changed by a bylaw of Cold Lake,

(

a) the council of Cold Lake consists of a Chief Elected Official and

6 other councillors,

(

b) the Chief Elected Official shall be elected at large,

(

c) Cold Lake is divided into 2 wards described in

Schedule 3, with 3

councillors to be elected for each ward, and

(

d) all councillors elected for a ward are to be nominated from and

resident in that ward.

17 The first general election for the new council shall be held on

October 15, 1996.

18 Denis Lafond, the Chief Administrative Officer of The Town of Cold

Lake, is appointed as Returning Officer for the first general election.

19 An organizational meeting is to be held after 12:00 noon on October

21, 1996.

20 Until the new council otherwise directs, Mark Power, the Chief

Administrative Officer of The Town of Grand Centre, is the Chief

Administrative Officer of Cold Lake.

SCHEDULE 2

THE TERRITORY OF COLD LAKE

All of the following described lands, including all road plans, railway

plans, and plans of subdivision contained therein, and all Government Road

Allowances adjoining the west and south boundaries thereof, lying in the

Province of Alberta, west of the Fourth Meridian:

Firstly:

All those lands contained within the Airport Boundaries for the Department

of National Defence (R.C.A.F.) Cold Lake, Alta., which are described as

Block "A" as shown on Plan 1169 RS (also known as 4 Wing Cold Lake).
