Summerville Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 30th day of June, A.D., 1971, pursuant to the provisions of

Section 2 of

Chapter 244 of the Revised Statutes, 1967, the Provincial Parks Act , is pleased to:

(

a) constitute all that area of land including land covered with water owned by Her

Majesty in right of the Province of Nova Scotia and situate at Summerville Beach in

the County of Queens, Province of Nova Scotia, to be a provincial park, said area of

land being included within the boundaries of the lands described in

Schedule “A”

attached to the report and recommendation and shown outlined on the Plan of

Survey marked

Schedule “B” attached to the report and recommendation; and

(

b) declare the name by which the park shall be known as “Summerville Beach

Provincial Park”.

Summerville Beach Provincial Park

All those certain lots, pieces, or parcels of land situate, lying and being at Summerville in the

County of Queens, Province of Nova Scotia as shown outlined in boldline on a plan no. E-811B

filed at the Crown Lands Records Centre, Dartmouth, Nova Scotia, marked

attached hereto and forming part of this Indenture , which parcels are more particularly bounded

and described as follows:

Beginning at the intersection of the southern boundary of Highway No. 3 with the southeast

boundary of an abandoned railway line, said point being situate on an abandoned railway line

curve to the left having a radius of 1239.43 feet;

Thence westerly following the arc of said curve along the northwesterly boundary of lands now

or formerly of Walter and Mary MacDonald, 283.57 feet to a point, said point being

S 68° 48' 26" W, 282.96 feet from last described point;

Thence N 27° 44' 46" W, 5.0 feet to a point;

Thence S 61° 13' 37" W, 43.88 feet to a point;

Thence S 32° 07' 45" E, 5.0 feet to survey marker Q2817;

Thence S 32° 07' 45" E, 13.65 feet along the southwesterly boundary of lands now or formerly

of Walter and Mary MacDonald to survey marker Q2816;

Thence S 32° 07' 45" E following the western boundary of lands now or formerly of Walter

and Mary MacDonald and the prolongation of said boundary 351 feet to a point, said point

being situate 300 feet seaward at right angles from the ordinary high water mark of

Summerville Beach;

Thence southwesterly 3600 feet more or less, parallel to and 300 feet from the ordinary high

water mark of Summerville Beach to a point;

Thence landward in a northerly direction 70 feet to the most southerly point of the ordinary low

water mark of Summerville Beach said point being situate 230 feet seaward at right angles from

the ordinary high water mark of Summerville Beach;

Thence westerly, northerly, and easterly along the ordinary low watermark of Broad River 6300

feet more or less to a point;

Thence N 0° 18' 11" E, 2 feet more or less to survey marker P2823;

Thence N 0° 18' 11" E, 36.77 feet to survey marker Q2822 on the southern boundary of

Highway No. 3;

Thence N 86° 12' 18" E, 7.28 feet along the southern boundary of Highway No. 3 to a point,

said point being the beginning of a curve to the right having a radius of 849.05 feet;

Thence following the southern boundary of Highway No. 3 along the arc of said curve 249.46

feet to a point, said point being S 85° 20' 50" E, 249.46 feet from the last described point;

Thence along the southern boundary of Highway No. 3, S 76° 53' 59" E, 156.42 feet to a point,

said point being the beginning of a curve to the right having a radius of 1406.61 feet;

Thence along the arc of the southern boundary of Highway No. 3, 112.67 feet to a point, said

point being the place of beginning and being S 74° 36' 18" E, 112.64 feet from last described

point.

The above described parcel contains 76 acres more or less including controlled water area.

The Governor in Council on the report and recommendation of the Acting Minister of Natural

Resources dated the 19th day of January, A.D., 1993, pursuant to

Section 8(

b) of

Chapter 367

of the Revised Statutes of Nova Scotia, 1989, the Provincial Parks Act , is pleased to decrease

by a total of 1 acre, more or less, the size of Summerville Beach Provincial Park, situate at

Summerville, in the County of Queens, so constituted by Order in Council 90-1452, dated the

11th day of December, A.D., 1990, by approving the withdrawal from the park of

approximately 1 acre, more or less, of Crown land shown outlined in red on the plan marked

Schedule “A”, attached to and forming part of the report and recommendation, and to authorize

the Minister of Natural Resources to execute such documents as may be necessary to achieve

the purposes of this Order.
