chapitre des Lois révisées de 2011, est modifiée par l’adjonction de ce qui suit après l’article 52 : Recovery through the Minister of National Revenue for Canada Recouvrements par l’entremise du ministre du Revenu national du Canada 52.1(1) In addition to the method of recovery under sub- section 52(1), if a person is indebted to the Province in a specific sum of money, the Comptroller may refer the amount of the indebtedness to the Minister of National Revenue for Canada to be recovered by means of applying to it the amount of any refund or repayment that may oth- erwise be made to the person under the Income Tax Act (Canada) or the New Brunswick Income Tax Act. 52.1(1) Outre la méthode de recouvrement prévue au paragraphe 52(1), si une personne doit à la province une somme d’argent déterminée, le contrôleur peut confier la créance au ministre du Revenu national du Canada aux fins de recouvrement en imputant sur la somme dont elle est redevable celle qui pourrait par ailleurs lui être remboursée en vertu de la Loi de l’impôt sur le revenu (Canada) ou de la Loi de l’impôt sur le revenu du Nouveau-Brunswick. 52.1(2) The types of indebtedness that may be referred to the Minister of National Revenue for Canada include, without limiting the generality of subsection (1), amounts owed by a person to the Province 52.1(2) Les types de créances qui peuvent être confiées au ministre du Revenu national du Canada incluent, sans que soit limitée la portée générale du paragraphe (1), toute somme qu’une personne doit à la province au

a) under

an Act of the Legislature or of the Parlia- ment of Canada or under a regulation made under such

an Act,

b) under a judgment or order of a court, tribunal or other competent authority,

b) d’un jugement ou d’une ordonnance d’une cour, d’un tribunal ou d’une autre autorité compétente; (

c) under a lease, loan, guarantee or other contract or instrument, or

c) d’un bail, d’un prêt, d’une garantie ou d’un autre contrat ou instrument; (

d) as reimbursement of an overpayment received by the person under a government program.

d) d’un trop-payé qui lui a été versé en vertu d’un programme gouvernemental. 52.1(3) If a limitation period applies to a claim to re- cover an amount of indebtedness referred to in subsection (1) and the limitation period expires after the amount of the indebtedness has been referred to the Minister of Na- tional Revenue for Canada under that subsection for re- covery, the amount nevertheless remains recoverable in the manner referred to in that subsection. 52.1(3) Si un délai de prescription applicable au recou- vrement d’une créance mentionnée au paragraphe (1) expire après qu’elle a été confiée en vertu de ce paragraphe au ministre du Revenu national du Canada aux fins de re- couvrement, la créance demeure néanmoins recouvrable selon la modalité que prévoit ce paragraphe.

Limitation of Actions Act

Section 27.1 of the Limitation of Actions Act,

chapter L-8.5 of the Acts of New Brunswick, 2009, is repealed and the following is substituted: 2 L’article 27.1 de la

chapitre L-8.5 des Lois du Nouveau-Brunswick de 2009, est abro- gé et remplacé par ce qui suit : 27.1 Despite anything else in this Act, if the limitation period that applies to a claim by the Crown for the recovery of money owing to it would, if not for this section, expire after the commencement of this

section but before May 1, 2016, that limitation period expires on May 1, 2016. 27.1

Malgré l’une quelconque des autres dispositions de la présente loi, expire le er mai tout délai de pres- cription applicable à une réclamation visant le recouvre- ment d’une créance de la Couronne qui, n’était le présent article, aurait expiré après l’entrée en vigueur du présent article, mais avant le 1er mai 2016.
