OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice dated March 23, 1999, pursuant to Sections 32A and 32H of

Chapter 240 of the Revised Statutes of Nova Scotia, 1989, the Judicature Act, as amended, is pleased to: (

a) designate Cape Breton District and Halifax District as judicial districts in which the Family Division of the Supreme Court may exercise its jurisdiction; (

b) confer on the Family Division of the Supreme Court exclusive jurisdiction over any and all charges, offences and matters arising from the following Acts or subjects: (

i) the Young Persons'

Summary Proceedings Act, (ii) the Children and Family Services Act, (iii) the Adult Protection Act, (iv) the Family Maintenance Act, (

v) the Maintenance Enforcement Act, (vi) the Maintenance Orders Enforcement Act, and (vii) the Reciprocal Enforcement of Custody Orders Act; (

c) confer on the Family Division of the Supreme Court concurrent jurisdiction over all charges, offences and matters arising from the following Acts or subjects: (

i) Sections 68 to 70 of the Labour Standards Code relating to the employment of children, (ii) Sections 111 to 120 of the Education Act relating to school attendance, (iii) Sections 172 and 215 of the Criminal Code (Canada), (iv) Sections 266 and 810 of the Criminal Code (Canada), where the parties are spouses or parent and child, (

v) Section 733.1 of the Criminal Code (Canada) for failure to comply with a probation order made by the court, and (vi)

Section 811 of the Criminal Code (Canada) for the breach of a recognizance made by the court; (

d) designate the Family Division of the Supreme Court as a youth court pursuant to the Young Offenders Act (Canada) and confer on the court concurrent jurisdiction over all charges, offences and matters arising under the Young Offenders Act (Canada); and (

e) designate the Family Court records and files in the Halifax District and the Cape Breton District as records and files of the Family Division of the Supreme Court for the Province of Nova Scotia, effective on, from and after the date of proclamation of

Chapter 5 of the Acts of 1997 (Second Session),
