HER MAJESTY, by and with the advice and consent of the Legislative Assembly

of the Province of British Columbia, enacts as follows:

Prescribing drugs for use for emergency

contraception

(1) B.C. Reg. 354/2000 has the retroactive effect

necessary to make pharmacy a prescribed health care profession on and after

October 26, 2000 for the purposes of the definition of "practitioner" in

section 1 of the Pharmacists, Pharmacy Operations and Drug Scheduling Act

only for the purposes of prescribing for use for emergency contraception the

drugs specified in

Schedule IV of B.C. Reg. 9/98, the Drug Scheduling

Regulation.

(2) B.C. Reg. 355/2000 has the retroactive effect

necessary to authorize, on and after October 26, 2000, pharmacists to prescribe

the drugs specified in

Schedule IV of B.C. Reg. 9/98, the Drug Scheduling

Regulation, in accordance with guidelines approved by the council.

(3) A pharmacist does not contravene

section 21 (1) (

a) of

the Pharmacists, Pharmacy Operations and Drug Scheduling Act by reason

only that the pharmacist made a prescription described by paragraph (g.1) of the

definition of "practice of pharmacy" in

section 1 of the Pharmacists,

Pharmacy Operations and Drug Scheduling Act on or after October 26, 2000 and

before this Act came into force.

Consequential Amendment

Section 1 of the Pharmacists, Pharmacy Operations and Drug Scheduling

Act, R.S.B.C. 1996, c. 363, is amended in the definition of "practice of

pharmacy" by adding the following paragraph:

(g.1) prescribing, in accordance with guidelines approved

by the council, a drug specified in

Schedule IV of B.C. Reg. 9/98, the Drug

Scheduling Regulation, for use for emergency contraception, .

Explanatory Notes

This Bill:

confirms the validity of B.C. Reg. 354/2000 and B.C. Reg. 355/2000, and

the prescription of drugs as specified in those regulations, on and after

October 26, 2000.

confirms that pharmacists have a limited authorization to

prescribe drugs for use for emergency contraception.
