EXPLANATORY NOTES

This Bill would amend the Automobile Insurance Act to

remove the requirement that

insurers notify the Registrar of Motor Vehicles of the cancellation or

expiration of a policy issued by the insurer; and

require the Superintendent of

Insurance and the Facility Association to allow an entity designated by the

Registrar of Motor Vehicles to access information as determined by the

Registrar of Motor Vehicles to enable the entity to create a database which the

Registrar of Motor Vehicles may access to verify that a vehicle is insured.

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

1. (1) Subsection 2(1) of the Automobile Insurance Act is amended by adding immediately after

paragraph (

j) the following:

(j.1) "Plan of Operation" means the Plan

of Operation established by the Facility Association in accordance with

subsection 98(2) of the Insurance

Companies Act ;

(2) Subsection 2(1) of the Act is amended by

adding immediately after paragraph (

l) the following:

(l.01) "registrar" means the Registrar of

Motor Vehicles;

(3) Subsection 2(1) of the Act is amended by

deleting the word "and" at the end of paragraph (l.1), deleting the

period at the end of paragraph (

m) and substituting a semi-colon and the word

"and" and by adding immediately after that paragraph the following:

(n) "Underwriting Information Plan"

means the plan required to be provided and administered by the Facility

Association under the Plan of Operation and which enables the collection of

data to assist in risk assessment by members of the Facility Association.

Section 6.01 of the Act is repealed and the

following substituted:

6.01 For

the purposes of enabling the creation of a database to allow the registrar to

verify that a vehicle is insured

(

a) the superintendent shall allow an entity

designated by the registrar to access the information determined by the registrar

from the information collected by the superintendent in accordance with the

automobile insurance statistical plan prepared under

section 82 of the Insurance Companies Act ; and

(

b) the Facility Association shall allow an entity

designated by the registrar to access the information determined by the registrar

from the information collected by the Facility Association in accordance with the

Underwriting Information Plan required under the Plan of Operation.
