Interpretation Act

OIC Text: The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Police Complaints Commissioner and Minister responsible for the Nova Scotia Police Review Board dated August 23, 2016, and pursuant to Sections 11 and 13 of

Chapter 31 of the Acts of 2004, the Police Act , and

Section 18 of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act , is pleased to, effective October 1, 2016: (

a) appoint Judith McPhee Q.C. of Halifax Regional Municipality (Bedford), to the position of Nova Scotia Police Complaints Commissioner for a term of three years; (

b) order that Judith McPhee Q.C. be remunerated for her services in the amount of $50 per hour up to eighty (80) hours a month and be reimbursed for reasonable expenses incurred in fulfilling her duties as Police Complaints Commissioner provided that such reimbursement does not exceed that normally payable to members of the civil service; (

c) revoke the appointment of Judith McPhee Q.C. of Halifax Regional Municipality (Bedford), as a member and her designation as Vice-chair of the Nova Scotia Police Review Board, made by Order in Council 2015-264, dated July 28, 2015; and (

d) order that the Province shall defend, negotiate or settle claims or charges made against Judith McPhee Q.C. and indemnify her from personal liability provided that the Province is satisfied the claim arises out of her activities in relation to her appointment as Nova Scotia Police Complaints Commissioner and is not based on fraud or criminal activity and where the Province so defends her, the Province will be in control of the case.
