Section 1 of the Agricultural Development Act, chap- ter A-5.1 of the Revised Statutes, 1973, is amended 1 L’article 1 de la

a) in the French version in the definition « Minis- tre » by striking out the period at the end of the defi- nition and substituting a semicolon;

b) by adding the following

definitions in alphabet- ical order:

section 12.4; “agriculture occupation permit” means an agriculture occupation permit issued under

section 12.1; “farming operation” means (

a) a farming business within the meaning of the In- come Tax Act (Canada), or (

b) a start-up farming operation that is following a management plan approved by the Minister; “lease area” means the land covered by an agriculture lease; « bail agricole » désigne le bail octroyé en vertu de l’ar- ticle 12.4; « exploitation agricole » s’entend :

section 12 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 12 : 12.1 The Minister may issue an agriculture occupation permit authorizing a person to use and occupy land under the administration and control of the Minister if the person 12.1 Le Ministre peut délivrer à une personne un permis d’occupation agricole l’autorisant à occuper et à utiliser un terrain placé sous son administration et sa surveillance aux conditions suivantes : (

a) makes an application on a form provided by the Minister,

c) elle paie les droits réglementaires, le cas échéant. 12.11 An agriculture occupation permit is valid for one year or for such shorter period as is specified by the Min- ister in the permit. 12.11 Le permis d’occupation agricole est valide pour une période d’un an ou pour la période plus courte que fixe le Ministre sur le permis. 12.2 An agriculture occupation permit is subject to the terms and conditions imposed by the Minister. 12.2 Le permis d’occupation agricole est assujetti aux modalités et aux conditions que fixe le Ministre. 12.21 An agriculture occupation permit is not assignable or transferable. 12.21 Le permis d’occupation agricole est incessible et ne peut être transféré. 12.3 The holder of an agriculture occupation permit is liable for actual damage to property caused by the holder of the agriculture occupation permit or any person acting on behalf of the holder of the agriculture occupation permit on the land covered by the agriculture occupation permit. 12.3 Le titulaire du permis d’occupation agricole est responsable des dommages réels aux biens causés par lui ou par son représentant sur le terrain que vise le permis. 12.31 The Minister may cancel an agriculture occupa- tion permit if the holder of the agriculture occupation per- mit 12.31 Le Ministre peut annuler le permis d’occupation agricole, si son titulaire : (

a) violates or fails to comply with this Act or the regulations,

c) requests in writing that the agriculture occupation permit be cancelled.

c) elle paie les droits réglementaires, le cas échéant. 12.41 An agriculture lease shall be for a period not ex- ceeding 20 years or, with the approval of the Lieutenant- Governor in Council, for such period of time as the Min- ister considers appropriate. 12.41 Le bail agricole est octroyé pour une période maximale de vingt ans ou, avec l’approbation du lieutenant-gouverneur en conseil, pour toute période que le Ministre estime appropriée. 12.5 An agriculture lease is subject to the terms, cove- nants and conditions imposed by the Minister. 12.5 Le bail agricole est assujetti aux modalités, aux co- venants et aux conditions que fixe le Ministre. 12.51(1) The holder of an agriculture lease shall pay rent in the amount, at the time and in the manner determined by the Minister. 12.51(1) Le titulaire du bail agricole paie un loyer dont le Ministre fixe le montant, le moment du paiement et les modalités de paiement. 12.51(2) From the date on which the amount of rent un- der this Act with respect to an agriculture lease is to be paid by any person, the amount bears interest at the rate prescribed in subsection 9(1) of New Brunswick Regula- tion 84-247 under the Revenue Administration Act. 12.51(2) À compter de la date à laquelle un loyer est exigible en application de la présente loi relativement au bail agricole, le montant qu’il représente porte intérêt au taux que fixe le paragraphe 9 (1) du Règlement du Nouveau-Brunswick 84-247 pris en vertu de la

Loi sur l’administration du revenu. 12.51(3) The amount of rent payable under this Act with respect to an agriculture lease, together with interest on the amount, that is due and unpaid by any person is a debt due to Her Majesty in right of the Province and may be recov- ered by action in her name in any court of competent ju- risdiction. 12.51(3) Le loyer à payer en application de la présente loi relativement au bail agricole qui demeure impayé ainsi que les intérêts sur ce montant constituent une créance de Sa Majesté du chef du la province et peuvent être recouvrés en justice par voie d’action intentée en son nom devant tout tribunal compétent. 12.6(1) The holder of an agriculture lease may, in ac- cordance with the terms, covenants and conditions of the agriculture lease, assign, transfer, sublet or set over the agriculture lease. 12.6(1) Le titulaire du bail agricole peut, conformément aux modalités, aux covenants et aux conditions du bail, le céder, le transférer, le sous-louer ou l’aliéner. 12.6(2) The transfer of an agriculture lease shall be 12.6(2) Le transfert du bail agricole : (

a) signed by the transferor or by the agent of the transferor, and

b) s’accompagne du paiement des droits réglemen- taires, le cas échéant. 12.61 The holder of an agriculture lease shall not, with- out the prior written approval of the Minister, mortgage, hypothecate, pledge or otherwise encumber the lease area. 12.61 Le titulaire du bail agricole ne peut l’hypothéquer, le donner en garantie ou le grever de toute autre manière sans obtenir au préalable l’approbation écrite du Ministre. 12.7 The holder of an agriculture lease is liable for actual damage to property caused by the holder of the agriculture lease or any person acting on behalf of the holder of the agriculture lease on the lease area. 12.7 Le titulaire du bail agricole est responsable des dommages réels aux biens causés par lui ou par son repré- sentant dans les limites du périmètre.

12.71(1) The Minister may renew an agriculture lease for a period not exceeding 20 years or, with the approval of the Lieutenant-Governor in Council, for such period of time as the Minister considers appropriate if 12.71(1) Le Ministre peut renouveler le bail agricole pour une période maximale de vingt ans ou, avec l’appro- bation du lieutenant-gouverneur en conseil, pour toute pé- riode qu’il estime appropriée, si sont remplies les condi- tions suivantes : (

a) before the agriculture lease expires, the holder of the lease

a) avant l’expiration du bail agricole, son titulaire : (

i) makes an application on a form provided by the Minister, (

i) présente une demande au moyen de la formule que lui fournit le Ministre, (ii) provides the Minister with such documentation and information as the Minister requires, and (ii) fournit les documents et les renseignements qu’exige le Ministre, (iii) pays the fee, if any, prescribed by regulation, and (iii) paie les droits réglementaires, le cas échéant; (

b) the Minister is satisfied that this Act, the regula- tions and the terms, covenants and conditions of the agriculture lease have been complied with.

a) violates or fails to comply with this Act or the regulations,

a) contrevient à la présente loi ou à ses règlements ou omet de s’y conformer; (

b) violates or fails to comply with a term, covenant or condition of the agriculture lease, or

b) contrevient à une modalité, à un covenant ou à une condition du bail agricole ou omet de s’y conformer; (

c) surrenders the agriculture lease.

a) in a manner in which personal service may be made under the Rules of Court, or

12.81(4) The cancellation takes effect on the date the notice of cancellation is served. 12.81(4) L’annulation prend effet à la date à laquelle est signifié l’avis d’annulation. 12.81(5) The person who held the agriculture lease shall, within the period of time specified by the Minister, 12.81(5) La personne qui était titulaire du bail agricole doit, dans le délai que fixe le Ministre : (

a) vacate the lease area, and

a) quitter le périmètre; (

b) rehabilitate the lease area to the satisfaction of the Minister.

b) remettre en état le périmètre d’une façon que le Ministre juge satisfaisante. 12.81(6) If the person who held the agriculture lease fails to rehabilitate the lease area to the satisfaction of the Minister, the Minister may rehabilitate the lease area at the expense of that person. 12.81(6) Si la personne qui était titulaire du bail agricole omet de remettre en état le périmètre d’une façon qu’il juge satisfaisante, le Ministre peut le remettre en état aux frais de cette personne. 12.9 When an agriculture lease expires or is surrendered or cancelled, the person who held the agriculture lease continues to be liable for any money owing with respect to rents, including interest on any amounts due and payable for which the person was liable immediately before the expiry, surrender or cancellation of the agriculture lease. 12.9 Lorsqu’un bail agricole expire ou est rétrocédé ou annulé, la personne qui en était titulaire continue d’être tenue de toute créance due au

titre des loyers, y compris les intérêts sur toutes les sommes dues et payables pour lesquelles elle était tenue immédiatement avant l’expira- tion, la rétrocession ou l’annulation. 12.91 When the holder of an agriculture lease dies, the heirs, executors, administrators or assigns of the holder of the agriculture lease are liable for any money owing with respect to rents, including interest on any amounts due and payable for which the holder of the agriculture lease was liable immediately before his or her death. 12.91 Lorsque le titulaire d’un bail agricole décède, ses héritiers, exécuteurs testamentaires, administrateurs suc- cessoraux ou ayants droit sont tenus de toute créance due au

titre des loyers, y compris les intérêts sur toutes les sommes dues et payables pour lesquelles il était tenu im- médiatement avant son décès. 12.92 For the purpose of ensuring compliance with this Act, the regulations, the terms and conditions of an agri- culture permit or the terms, covenants and conditions of an agriculture lease, the Minister may, at any reasonable time, 12.92 Afin d’assurer le respect de la présente loi, de ses règlements, des modalités et des conditions du permis d’occupation agricole ou des modalités, des covenants et des conditions du bail agricole, le Ministre peut, à toute heure raisonnable : (

a) enter and inspect any land covered by an agricul- ture occupation permit or any lease area, and

a) pénétrer sur le terrain visé par le permis d’occupa- tion agricole ou dans le périmètre et en faire l’inspec- tion; (

b) conduct tests, make inquiries and take samples, measurements, photographs or audio or visual record- ings that the Minister considers necessary.

b) effectuer les analyses, obtenir les renseignements, prendre les échantillons, les mesures, les photos ou les enregistrements audios ou vidéos qu’il estime néces- saires. 12.93 The holder of an agriculture occupation permit or an agriculture lease or any person acting on behalf of the holder of the agriculture occupation permit or agriculture lease shall not obstruct or interfere with the Minister while he or she is carrying out or attempting to carry out an in- spection under this Act. 12.93 Le titulaire du permis d’occupation agricole ou du bail agricole ou son représentant ne peut entraver ou gêner le Ministre pendant qu’il procède ou tente de procéder à l’inspection que prévoit la présente loi.

12.94(1) Any lease granted by the Minister for agricul- tural purposes after December 31, 1992, and before the commencement of this

section shall be deemed to have been validly granted and is confirmed and ratified. 12.94(1) Les baux qu’octroie le Ministre à des fins agri- coles après le 31 décembre 1992 et avant l’entrée en vi- gueur du présent

article sont réputés avoir été valablement octroyés et sont confirmés et ratifiés. 12.94(2) Any act or thing done after December 31, 1992, and before the commencement of this

section by the Min- ister with respect to the leases referred to in subsection (1) shall be deemed to have been validly done and is con- firmed and ratified. 12.94(2) Toute action ou toute chose que le Ministre ac- complit après le 31 décembre 1992 et avant l’entrée en vigueur du présent

article relativement aux baux mention- nés au paragraphe (1) est réputée avoir été valablement accomplie et est confirmée et ratifiée. 12.94(3) No action, application or any other proceeding to question or in which is questioned the validity of the leases referred to in subsection (1) or the authority of the Minister to grant such leases, shall lie or be instituted against Her Majesty in right of the Province or the Minister or any person appointed, assigned, designated or requested to assist the Minister with respect to such leases, if the Minister or person acted in good faith in granting the lease. 12.94(3) Sont irrecevables les actions, requêtes ou au- tres actes de procédure mettant en question ou dans les- quels est contestée la validité des baux mentionnés au pa- ragraphe (1) ou l’autorité du Ministre d’octroyer ces baux introduits contre Sa Majesté du chef de la province, le Mi- nistre ou toute personne nommée, affectée, désignée ou requise pour assister le Ministre relativement à ces baux, si le Ministre ou l’autre personne a agi de bonne foi en procédant à cet octroi. 12.94(4) Sections 12.5 to 12.93 apply with the necessary modifications to the leases referred to in subsection (1). 12.94(4) Les articles 12.5 à 12.93 s’appliquent avec les adaptations nécessaires, aux baux visés au paragra- phe (1). 3 Subsection 13(1) of the Act is amended 3 Le paragraphe 13(1) de la Loi est modifié (
