B.C. Reg. 26/2011 , deposited February 11, 2011, pursuant to the LIQUOR CONTROL AND LICENSING ACT [Sections 12.01 (11) and 84] and the MISCELLANEOUS STATUTES AMENDMENT ACT (No. 3), 2010 [Section 247]. Order in Council 39/2011, approved and ordered February 10, 2011.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) section 117 of the Miscellaneous Statutes Amendment Act (No. 3) , 2010 S.B.C. 2010, c. 21, is brought into force,

(

b) section 12.01 of the Liquor Control and Licensing Act , R.S.B.C. 1996, c. 267, is repealed, and

(

c) the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended as set out in the attached Schedule.

Schedule

Section 10 (3) of the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended by striking out paragraphs (e), (

f) and (

g) and substituting the following:

(

e) the impact of noise on the community in the immediate vicinity of the establishment; .

Section 40 (3) is repealed and the following substituted:

(3) The dispensing of beverages containing liquor at a service bar must be done in full view of the patrons.

Section 67 is amended

(

a) by repealing subsection (1) and substituting the following

(1) In this section, "business day" means, in respect of a licensee, a day specified by the general manager as a business day. , and

(

b) in subsection (2) (

b) by striking out " succeeding ".
