An Act to Amend the Smoke-free Places Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Smoke-free Places Act,

chapter of the Revised Statutes, 2011, is repealed and the follow- ing is substituted: 3(1) Except as provided in

section and subsection 5(1), no person shall smoke (

a) in an enclosed public place, (

b) in an indoor workplace, (

c) in a group living facility, (

d) in a public vehicle, (

e) in a vehicle while another person in the vehicle is under the age of 16 years, (

f) in a vehicle used in the course of employment, while carrying two or more employees, (

g) on the grounds of a school, or (

h) within metres of children’s playground equip- ment that is in an outdoor public place. PROJET DE LOI Loi modifiant la

Loi sur les endroits sans fumée, cha- pitre des Lois révisées de 2011, est abrogé et rem- placé par ce qui suit : 3(1) Sauf ce qui est prévu à l’article et au paragra- phe 5(1), nul ne peut fumer dans les endroits suivants :

a) un endroit public fermé;

b) un lieu de travail intérieur;

c) un établissement où les gens vivent en groupe;

d) un véhicule public;

e) dans un véhicule alors qu’une autre personne à bord a moins de seize ans;

f) un véhicule utilisé dans le cadre d’un emploi, ayant à son bord deux employés ou plus;

g) la propriété d’une école;

h) à 10 mètres ou moins d’un matériel de terrain de jeux pour enfants installé dans un endroit public exté- rieur. 2 Projet de loi Loi modifiant la

h) does not apply to a person (

a) in a motor vehicle, unless the motor vehicle is sta- tionary, (

b) in an area that is separated from the children's playground equipment by a road, or (

c) at residential premises or on land on which resi- dential premises are built or may lawfully be built. 2 The Act is amended by adding after subsection 6(2) the following: 6(3) Subsections (1) and (2) do not apply to the smoking prohibition outlined in paragraph 3(1)(h). 3 This Act comes into force on a day to be fixed by proclamation. 3(2) L’alinéa

c) dans des lieux résidentiels ou sur un terrain abri- tant ou pouvant légalement abriter des lieux résiden- tiels. 2 La Loi est modifiée par l’adjonction après le para- graphe 6(2) de ce qui suit : 6(3) Les paragraphes (1) et (2) ne s’appliquent pas à l’interdiction de fumer visée à l’alinéa 3(1)h). 3 La présente loi entre en vigueur à la date fixée par proclamation.
