B.C. Reg. 99/2009 , deposited March 13, 2009, pursuant to the EMPLOYMENT AND ASSISTANCE ACT [Section 35] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26]. Order in Council 227/2009, approved and ordered March 12, 2009.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective April 28, 2009, the Employment and Assistance Regulation, B.C. Reg. 263/2002, and the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, are amended as set out in the attached Schedule.

Schedule

Section 4.1 of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended by adding the following subsection:

(6) Subsection (2) (

b) does not apply to a sole applicant who

(

a) has a dependent child, or

(

b) provides care to a child in the home of a relative, a foster child or a child in their care under an agreement referred to in sections 8 or 93 (1) (g) (ii) of the Child, Family and Community Service Act

if the child has not reached 3 years of age.

Section 4.1 of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended by adding the following subsection:

(6) Subsection (2) (

b) does not apply to a sole applicant who

(

a) has a dependent child, or

(

b) provides care to a child in the home of a relative, a foster child or a child in their care under an agreement referred to in sections 8 or 93 (1) (g) (ii) of the Child, Family and Community Service Act

if the child has not reached 3 years of age.
