d) and 8]. Order in Council 199/2019, approved and ordered April 15, 2019.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective April 15, 2019,

(

a) the North American Gypsy Moth Eradication Regulation, 2018, B.C. Reg. 74/2018, is repealed, and

(

b) the attached North American Gypsy Moth Eradication Regulation, 2019 is made.

1 In this regulation:

"Btk" means an insecticide containing Bacillus thuringiensis var. kurstaki as its active ingredient;

"gypsy moth" means the North American gypsy moth;

"North Surrey gypsy moth treatment zone" means the area within the treatment boundary outlined in heavy black on the map in the Schedule.

Eradication of gypsy moth

(1) During the period beginning April 15, 2019 and ending June 30, 2019, an inspector may, subject to subsection (2), apply Btk using an aerial spray in the North Surrey gypsy moth treatment zone.

(2) An inspector may apply Btk in the North Surrey gypsy moth treatment zone only if

(

a) the application is done in accordance with the Integrated Pest Management Act and its regulations,

(

b) the inspector is licensed under that Act, and

(

c) the application is done no more than 4 times.

(3) During the period beginning April 15, 2019 and ending November 30, 2019, an inspector may enter on land in the North Surrey gypsy moth treatment zone to

(

a) search for and remove gypsy moth eggs,

(

b) search for gypsy moths, and

(

c) set or retrieve traps for gypsy moths.
