LOI SUR LA PROTECTION DE LA SANTÉ DES FORÊTS (ARBRES REMARQUABLES) Moved by the Honourable Mr. Mackintosh Motion de M. le ministre Mackintosh THAT Bill be amended in Clause by adding the following after the proposed subsection 26.3(4): Il est proposé que le projet de loi soit amendé dans l'article par adjonction, après le paragraphe 26.3(4), de ce qui suit : Nomination process for trees on private land 26.3(4.1) If a nominated tree is located on private land (

a) the owner of the land must be given a copy of the nomination; (

b) the owner of the land must be given an opportunity to make a written submission to the heritage tree review committee before the committee makes its recommendation on the nomination; (

c) any submission made by the owner of the land must accompany the heritage tree review committee's recommendation to the minister; and (

d) the minister must have regard to the owner's submission when deciding whether to designate the tree as a heritage tree. Procédure — demande de reconnaissance d'arbres situés sur des terrains privés 26.3(4.1) Les règles indiquées ci-dessous s'appliquent lorsqu'un arbre faisant l'objet d'une demande de reconnaissance est situé sur un terrain privé :

a) le propriétaire du terrain doit recevoir une copie de la demande;

b) le propriétaire doit avoir la possibilité de présenter des observations écrites au Comité d'examen des demandes de reconnaissance avant que celui-ci fasse des recommandations au sujet de la demande;

c) les observations du propriétaire doivent accompagner les recommandations que le Comité d'examen des demandes de reconnaissance transmet au ministre;

d) le ministre doit tenir compte des observations du propriétaire lorsqu'il décide de donner droit ou non à la demande de reconnaissance.
