EXPLANATORY NOTE

This Bill would amend

section 4 of

the Members of the House of Assembly

Retiring Allowances Act to provide that where a member of the House of

Assembly retired on or before December 31, 2003, pension payments to that

retired member and related benefits payable on or after January 1, 2004 will be

paid out of the Members Supplementary Plan Account established in the

Consolidated Revenue Fund. Allowances

and other benefits payable to members retiring after December 31, 2003 would be allocated between the Registered Pension Plan and the

Supplementary Plan in accordance with Parts III and IV of the Act.

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

Section 4 of the Members of the House of Assembly Retiring Allowances Act is amended

by renumbering it as subsection 4(1) and by adding immediately after that subsection the following:

(2) Notwithstanding another provision of this Act

or another Act, where a member retired on or before December 31, 2003 and is in

receipt of an allowance under this Act, the allowance and related benefits

under this Act payable on or after January 1, 2004 shall be paid from the Members

Supplementary Plan Account established under

section 17.

Commencement

2. This Act shall be considered to have come into force

on December

31, 2003 .
