OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated the August 13, 1998, pursuant to clauses 16(1)(
a) and 16(1)(
b) of
Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the granting of an option agreement(
s) and an easement(
s) over Crown lands, including watercourse lands, along the mainline pipeline route shown on the plan marked
Schedule "A" attached to and forming part of the report and recommendation and to approve the conveyance by grant or deed of Crown lands for mainline valve sites along the easement lands, along with associated rights of way to the mainline valve sites, to Maritimes and Northeast Pipeline Limited Partnership, by its General Partner, Maritimes Northeast Pipeline Management Ltd., for the purpose of installing, maintaining and using a natural gas pipeline, upon the following terms: (
a) easements will be 25 metres wide, more or less, with additional permanent push out areas as approved by the Department of Natural Resources; (
b) mainline valve sites will be situated as approved by the Department of Natural Resources and will be 1 acre, more or less, in size; (
c) rights of way to the mainline valve sites will be provided where no other reasonable access is available; (
d) the fee for the easements will be $350.00 per watercourse crossing and $400.00 per acre for all other Crown land, the exact acreage to be confirmed by survey; (
e) the fee for mainline valve sites will be $800.00 per acre; (
f) payment of damages, administrative fees and reimbursement of costs as agreed to by the Department of Natural Resources; (
g) reversion to the Crown of all mainline valve site lands and associated rights of way and surrender of the easements at the option of the Crown in the event that the pipeline is abandoned in accordance with the provisions of the National Energy Board Act; and (
h) compliance with the laws of the Province of Nova Scotia and without limiting the generality of the foregoing, in particular the requirements of the Department of the Environment and Department of Labour; and to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
