B.C. Reg. 173/2005, deposited March 24, 2005, pursuant

to the MOTOR VEHICLE AMENDMENT ACT, 2004 [Section 24 (1)]

and the MOTOR VEHICLE ACT [Section 210]. Order in Council 352/2005,

approved and ordered March 24, 2005.

On the recommendation of the undersigned, the Lieutenant Governor,

by and with the advice and consent of the Executive Council, orders that, effective

April 1, 2005,

(

a) sections 1, 3 to 6 and 12 to 16 of the Motor Vehicle Amendment Act,

2004 , S.B.C. 2004, c. 68, are brought into force, and

(

b) the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended

(

i) by adding

section 1.01 as follows:

Prescribed date for motor vehicle related offence

1.01 For the purpose of paragraph (

d) of the definition

of "motor vehicle related Criminal Code offence" in

section 1

of the Act, an offence committed under

section 249.1 of the Criminal

Code on or after April 1, 2005, is a motor vehicle related Criminal

Code offence. , and

(ii) in Division 28, in Table 4 of the Schedule, under Criminal Code,

by adding the following after item 12:

(3) Flight

causing bodily harm or death.
