North Bay Ingonish Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-1036 (September 7, 1976), N.S. Reg. 143/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 9th day of August, A.D., 1976, pursuant to

Section 5(1) of

Chapter 6 of the

Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to

designate as a beach an area of land lying landward from the mean high watermark of North

Bay Ingonish Beach, in the County of Victoria, Province of Nova Scotia, as shown outlined in

red on the copy of Crown Land Records Office Plan No. E-7-79, marked

Schedule “B” and

described in

Schedule “A”, both Schedules attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high watermark of North Bay

Ingonish Beach, in the County of Victoria, Province of Nova Scotia as shown outlined in red

on the copy of Crown Land Records Office Plan No. E-7-79, attached hereto and marked

Schedule “B” and being more particularly described as follows:

Beginning at a wooden post marked No. 2 situate on the northern boundary of Cape Breton

Highlands National Park, said wooden post being a distance of one hundred forty-seven

feet more or less from the ordinary high watermark of North Bay, Ingonish, as shown on a Plan

of Cape Breton Highlands National Park, recorded in the Crown Land Records Office,

Department of Lands and Forests, Halifax, under file number B-9-7;

From thence (by astronomic bearings referred to observations on the National Park boundary at

Monument NP25) following the northerly boundary of Cape Breton Highlands National Park,

south seventy-seven degrees three minutes zero seconds west, one hundred fifty decimal zero

feet to a point shown as Point “B” on said Plan E-7-79;

Thence north two degrees eighteen minutes six seconds east, two thousand seven hundred

forty-five decimal fifty-two feet to a point shown as Point “A” on said Plan E-7-79, said

point being south seventy-seven degrees three minutes zero seconds west, one hundred decimal

zero feet from an iron post #V2111;

Thence north thirteen degrees twenty-four minutes six seconds east, two thousand four hundred

eighty-four decimal forty-seven feet to a point shown as Point “C” on said Plan E-7-79;

Thence south seventy-six degrees twenty-one minutes eighteen seconds east, one hundred

decimal zero feet to iron post #V2112;

Thence continuing south seventy-six degrees twenty-one minutes eighteen seconds east, fifteen

hundred sixty decimal zero feet to a calculated Point “D” situate in the waters of North Bay,

Ingonish;

Thence south six degrees fifty-two minutes sixteen seconds west four thousand three hundred

ninety-two decimal seven six feet to a calculated Point “E” situate in the waters of North Bay,

Ingonish;

Thence south seventy-seven degrees zero three minutes zero seconds west, one thousand six

hundred and seventy decimal zero feet to the place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high watermark.
