GIBBONS First Reading Second Reading Committee of the Whole Third Reading Royal Assent Bill Mr. Gibbons BILL PRO VINCIAL-M UNICIPAL TAX SHARING CALCULATIO N ACT (Assented to ,1999) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: D efinitions In this Act, (a) “income tax revenues” means income tax received from individuals pursuant to sections to of the Alberta Income Tax Act; (b) “municipality” means (

i) a city, town, village, summer village, municipal district or specialized municipality, (ii) a town under the Parks Towns Act, or (iii) a municipality formed by special Act, or, if the context requires, the geographical area within the boundaries of a municipality described in subclauses (

i) to (iii). R eport by the P rovincial Treasurer At the end of each fiscal year, commencing with the fiscal year ending March 31, 2000, the Provincial Treasurer shall prepare a report on how the financial affairs of the Government would have been affected by sharing income tax revenues with municipalities. C alculation of tax revenues to m unicipalities 3(1) In preparing the first report under

section 2, the Provincial Treasurer shall assume that 11% of income tax revenues are Making the report public Coming into force allocated to municipalities.

(2) For the purposes of preparing the report required under

section for each subsequent fiscal year, the Provincial Treasurer shall use as a basis for the report a percentage of income tax revenues as approved by resolution of the Assembly.

(3) Each year, after March 31, 2000, the Provincial Treasurer shall introduce a motion in the Legislative Assembly proposing a percentage figure for the purposes of subsection (2).

(4) In the event the motion moved under subsection (3) is not passed by the Assembly by June in any year, the Provincial Treasurer shall use the same percentage figure for the current fiscal year as in the report for the previous fiscal year. 4(1) The Provincial Treasurer shall lay the report prepared under

section before the Legislative Assembly, if it is sitting, when the report is completed, or if it is not then sitting, within 15 days after the commencement of the next sitting.

(2) If the Legislative Assembly is not sitting when the report is completed, the Provincial Treasurer shall make the report public by depositing a copy with the Clerk of the Legislative Assembly and providing a copy to each Member of the Legislative Assembly. 5 This Act comes into force upon Proclamation. 2 Title: 1999 (24th, 3rd) Bill 227, Provincial-Municipal Tax Sharing Calculation Act
