OIC Text: The Governor in Council on the report and recommendation of the Minister of Lands and Forestry dated September 10, 2020, and pursuant to clauses 7(a), 16(1)(

a) and 16(1)(

b) of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act , is pleased to approved the Minister to: (

a) issue a grant and/or a deed to convey Crown lands identified as PID 45245578 and a portion of PIDS: 45182797, 45245560, 45245552, 45184025 and 45182904, containing approximately 261.47 hectares (646.09 acres), located at Cogmagun, Hants County, and shown outlined in bold on the plan marked

Schedule “A”, which is attached to and forms part of the Report and Recommendation, to the Municipality of the District of West Hants, or its successor or assign, for the amount of $176,800.00, plus HST as applicable; (

b) issue an easement over portions of Crown lands being retained by the Department of Lands and Forestry, being 20 metres in width and containing approximately 7.1 hectares (17.54 acres), for Crown lands located at Cogmagun, Hants County and shown outlined in bold on the plan marked

Schedule “B” which is attached to and forms part of the Report and Recommendation, to the Municipality of the District of West Hants or its successor or assign, for consideration of $1.00, subject to an option agreement; (

c) enter into an option agreement with the Municipality to give the Department an option to repurchase the Crown lands if the Municipality does not use it for the purposes of constructing and operating a composting facility or if it is not sold to a third party for the purposes of constructing and operating a composting facility; and (

d) execute such documents as may be necessary to achieve the purposes of this Order.
