On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective June 30, 2025,

(

a) the Commercial Liens Act , S.B.C. 2022, c. 9, is brought into force, and

(

b) the attached Commercial Liens Regulation is made.

COMMERCIAL LIENS REGULATION

Direction of seizure – prescribed information

1 For the purposes of

section 32 (4) [seizure by bailiff] of the Act, the following information is prescribed to be included in a direction of seizure:

(

a) the name of the bailiff;

(

b) the name of the lien holder;

(

c) the name of the person who took possession of the goods from the lien holder;

(

d) the date on which the lien holder signed the direction of seizure;

(

e) the location of the goods, if known by the lien holder.

Bailee’s undertaking – prescribed information

(1) In this section, "base registration" has the same meaning as in the Personal Property Security Regulation.

(2) For the purposes of

section 34 (1) (c) [bailiff may appoint bailee] , the following information is prescribed to be included in the undertaking:

(

a) the name of the bailiff;

(

b) the name of the person who is to be designated as the bailee;

(

c) the date on which the person who is to be designated as the bailee signs the undertaking;

(

d) a description of the goods to be held by the person who is to be designated as the bailee;

(

e) the address of the location, or, if no address is available, a description of the location where the person who is to be designated as the bailee will hold the goods;

(

f) the base registration number in relation to the lien.
