Explanatory Note I. This Act is a revision of The Psychiatric Nurses Training Act (chapter 251 of the Revised Statutes). 2.

Definitions. The definition of "mental deficiency nurse" is new. 3. Sections 3 and 4 of the present Act read as follows: 3. There is hereby oonstituted an advisory committee consisting of the Director of the Division of Mental Health, who shall be chairman, the Medical Superintendent and the Superintendent of Nurse·s of the Provincial Mental Hospital, the Provincial MenW Institute, and any other hospital operating a school, and a representative appointed by the Alberta Psychiatric Nurses' Association. 4.

(1) The committee shall meet at such times and at such p.laces as may be fixed from time to time ·by tne chairman.

(2) Three members of the committee constitute a quorum for the transaction of business.

(3) In the absence of the chairman the committee may appoint a member to act as deputy chairman, and the member thus appointed may perform all tpe p.owers and functions of the chairman.

An Act respecting the Training O'f Psychiatric and M'ental Deficiency Nurses (Assented to ,1966) HER MAJESTY, by and with the advice and cO'ns'ent of the Legislative Assembly of the PrO'vince of Alberta, enacts as follows: 1. This Act may be cited as "The Psychiatric Nursing Training Act". 2.

In this Act, (a) "committee" means the advisO'ry cO'mmittee cO'n stituted under sectiO'n 3; (b) "mental deficiency nurse" means a person to' whom a certifica,te in mental deficiency nursing has been issued in accordance with the regulatiO'ns; (c) "psyc:hiatric nurse" means a persO'n to' whom a cer tificate in psychiatric nursing has been issued in accO'rdance with the regulatiO'ns; (d) "schO'O'r' means an institutiO'n apprO'ved by the committee fO'r the training O'f persons in psychiatric nursing O'r mental deficiency nursing. 3.

(1) There is hereby constituted an advisory commit tee consisting of (

a) the DirectO'r of Mental Health, whO' shall he chair man, (

b) the Assistant DirectO'r O'f Mental Health, (

c) the Medical Superintendents and DirectO'rs of Nurses of . (

i) the Alberta Hospital, EdmO'nton, (ii) the Alberta HO'spital, Ponoka, and (iii) the Alberta School HO'spital, Red Deer, (

d) a representative appointed by the Alberta Psy chiatric Nurses' AssO'ciatiO'n, (

e) a repr'esentative apPO'inted by the Alberta ASSO'ci a tion of Registered Nurses, (

I) a representative appointed by the Alberta HO'spital Associa tiO'n, and (

g) a representative appointed by the College O'f Phy sicians and SurgeO'ns.

Section 5 of the present Act reads as follows: 5. The committee shall p.erform such duties and functions in respect of tl}e training and qualifying of persons to become psychiatric nurses and the practice of persons who have become psychiatric nurses as the Minister may prescribe by regulations made hereunder. 5. Cancellation of certificates. This is a new section. 6. The present

section 6 revised.

(2) In the absence of the chairman, the Assistant Director of Mental Health may act as chairman, and in so doing may exercise all the pow,ers and duties Df a member of the committee and the chairman of the committee.

(3) Six members of the committee constitute a quorum for the transactioOn of business. 4.

(1) The committee shall perform such duties and functions, as may be prescribed by the regulatiDns, in respect of (

a) the training of and qualificatiDn of perSDns to become psychiatric nurses, (

b) the training of and qualification of persons to hecome mental deficiency nurses, and (

c) the qualificatioOn of persons to become psychiatric nurs,es or mental deficiency nurses by the recog nition of equivalent training obtained outside the Province.

(2) A certificate in psychiatric nursing or in mental deficiency nursing shall be issued only to a person found by the cO'mmittee toO be qualified to receive that certificate. 5.

(1) Where, after an inquiry, thecommitte'e is satis fied there is good and adequate cause for SD dDing, it may oOrder the cancellation of a certificate in psychiatric nursing Dr a certificate in mental deficiency nursing, and the cer tificate shall be cancelled forthwith.

(2) A person whoOsecertHicate is Drderedcancelled may appeal on Driginating notice to' the Supreme Court within thirty days of the service Dn him of nDtice Df the Drder or within such further time as a judge of the Supreme CDurt may Drder.

(3) A perSDn appealing against an Drder Df the 'cDmmi ttee shall serve noOtice Df the appeal upDn thechair'man Df the cDmmittee 'within the Ume limited fDr appeal.

(4) The judge, upon hearing the appeal, may make an Drder either confir,ming or reversing the oOrder Df the com mittee appealed a1gainst. 6. The Lieutenant GoOvernoOr in CDuncil may make regula tiDns in respect Df 2 (

a) the duties and ;functiDns of the cDmmittee, (

b) the qualifications toO be required Df thDse entering a SCihDOI, (

c) the CoOurses of study toO be adDpted in schoO DIs, (

d) the examinatiDns to be taken by perSDns studying in SChDOls and the cDnduct of such examina tiDns, (

e) the issuing Df certificates toO thDse WhD have taken the requiredcDurses of study and who have passed the examinations,

7. Repeal of

chapter 251 of the Revised Statutes. 8. Commencement of Act. 3

(

I) the procedure on invesUgations and the cancellation ofcertitficates, (

g) the granting of certificates to persons practising as psychiatric nurses before the first day of April, 1955, (

h) the granting of certificates to persons practising as mental deficiency nurses before the first day of July, 1966, and (

i) any other matters pertaining to the training of and qualification of persons as psychiatric nurses or mental deficiency nurses. 7.

(1) This Act repeals and replaces The Psychiatric Nurses Training Act.

(2) Any 'certificates issued under The Psychiatric Nurses Training Act and still suhsisting shall be deemed to be issued under this Act. 8. Tthis Act cnmes into force on the day upon which it is assented to. 3
