WHEREAS

section 98 of the Freedom of Information and Protection of Privacy

Act provides that that Act comes into force on Proclamation; and

WHEREAS it is expedient to proclaim certain provisions of that act in

force;

NOW KNOW YE THAT by and with the advice and consent of our Executive

Council of Our Province of Alberta, by virtue of the provisions of the said

Act hereinbefore referred to and of all other power and authority

whatsoever in Us vested in that behalf, We have ordered and declared and do

The Lieutenant Governor in Council

(

a) dissolves The Village of Blackie at the end of August 31, 1997,

(

b) directs that on the dissolution of The Village of Blackie its

area becomes part of The Municipal District of Foothills No. 31, and

(

c) makes the order in the Schedule.

SCHEDULE

1. In this Schedule,

(a) "Blackie" means The Village of Blackie;

(b) "receiving municipality" means The Municipal District of

Foothills No. 31.

2. For the 1998 taxation year, the assessor for the receiving municipality

shall assess both land and assessable improvements to the land that are

presently located in Blackie. The assessments shall be fair and equitable,

taking into consideration assessments of similar land and improvements in

the receiving municipality.

3. All assets, liabilities, whether arising from under a debenture or

otherwise, rights, duties, functions and obligations of Blackie at its

dissolution are vested in the receiving municipality and may be dealt with

in the name of the receiving municipality.

4. After August 31, 1997, a reference to Blackie in any order,

regulation, bylaw, certificate of title, agreement or any other instrument

is deemed to be a reference to the receiving municipality.

5(1) The receiving municipality shall take

(

a) money received from Blackie at its dissolution, and

(

b) if the receiving municipality sells, on or before December 31,

2000, any of the assets vested in it under

section 3, money received from

the sale of those assets

and deposit it in a capital reserve fund established by the receiving

municipality.

(2) The funds in the capital reserve fund may only be used:

(

a) to pay or reduce any liabilities transferred to the receiving

municipality from Blackie at its dissolution, or

(

b) for capital projects within the area that was located within

Blackie.

6. Despite sections 354 and 358 of the Municipal Government Act, the

receiving municipality may in its property tax bylaw for 1998 and

subsequent years set an additional tax rate on property (including linear

property) within the area that was located within Blackie to pay the

general debenture debt of Blackie at its dissolution.
