An Act to Amend the Individual's Rights Protection Act Bill Mr. R. Speaker BILL 201

AN ACT TO AMEND THE INDIVIDUAL'S RIGHTS PROTECTION ACT (Assented to , 1980) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: 1. The Individual’s Rights Protection Act is amended by this Act. 2. The following is added after

section II: 11.1

(1) Notwithstanding any other provision of this Act, it is not unlawful for any person to adopt or carry out a special program, plan or arrangement where that special program, plan or arrange ment is designed (

a) to prevent or reduce disadvantages that are likely to be suffered by, or (

b) to eliminate or reduce disadvantages that have been or are suffered by any group of individuals, by improving opportunities respecting goods, services, accommodation or employment in relation to that group when (

c) the disadvantages are based or related to the grounds for discrimination forbidden by section 2(1), and (

d) any disadvantage to another group which is based on or related to the grounds for discrimination forbidden by section 2(1) and Which results from the special program, plan or arrangement is outweighed by the benefits that the whole community gains from the reduction or elimination of disadvantages by the special program, plan or arrange ment.

(2) Any person may apply to the Commission for a determina tion as to whether a program, plan or arrangement adopted or car ried out or to be adopted or carried out by that person or any other person is a program, plan or arrangement permitted by subsection (1) and the Commission shall notify the applicant of its determina tion within 60 days of the application. 3. This Act comes into force on the day upon which it is assen ted to. Explanatory Notes 1 . This Bill will amend
