PERSONAL INFORMATION PROTECTION AMENDMENT ACT, 2018

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the

Province of British Columbia, enacts as follows:

This Bill would amend the Personal Information Protection Act to replace gendered language with gender neutral language.

Section 8 of the Personal Information Protection Act, R.S.B.C. 2003, c. 63, is amended

(

a) in subsection (2) by striking out " his or her " and substituting " their " and by striking out " he or she " and substituting " they ",

(

b) in subsection (2) (

a) by striking out " is a beneficiary " and substituting " are a beneficiary ",

(

c) in subsection (2) (

b) by striking out " is not the applicant " and substituting " are not the applicant ", and

(

d) in subsection (3) (

b) by striking out " his or her " and substituting " their ".

Section 9 is amended

(

a) in subsection (2) by striking out " his or her " and substituting " their ", and

(

b) in subsection (3) by striking out " his or her " and substituting " their ".

Section 23 is amended

(

a) in subsection (3) (

e) by striking out " he or she was " and substituting " they were ", and

(

b) in subsection (4) (

d) by striking out " his or her " and substituting " their ".

Section 27 is amended by striking out " access to his or her personal information " and substituting " access to their personal information " and by striking out " correction of his or her personal information " and substituting " correction of their personal information ".

Section 38.1 (1) is amended by striking out " he or she considers " and substituting " they consider ".

Section 51 is amended by striking out " his or her " and substituting " their ".

Section 52 is amended

(

a) in subsection (2) (a) (

i) by striking out " his or her " and substituting " their ",

(

b) in subsection (2) (

b) by striking out " his or her " and substituting " their ", and

(

c) in subsection (2) (

c) by striking out " his or her " and substituting " their ".

Section 56 is amended

(

a) in subsection (1) (

c) by striking out " his or her " and substituting " their ", and

(

b) in subsection (1) (

d) by striking out " his or her " and substituting " their ".

Explanatory Note

This Bill would amend the Personal Information Protection Act to replace gendered language with gender neutral language.
