Alberta Regulation 41/2025

Public Lands Act

RECREATIONAL ACCESS AMENDMENT REGULATION

section 9 of the Public Lands Act jointly with a

corresponding order made by the Minister of Forestry and Parks (M.O. 6/2025) on

March 26, 2025 pursuant to

section 62.1 of the Public Lands Act.

1 The Recreational Access Regulation (AR 228/2003) is

amended by this Regulation.

Section 1(1) is amended

(

a) by repealing clause (

c) and substituting the

following:

(c) "bicycle" means any cycle on which a person may ride,

regardless of the number of wheels it has, and includes a

power bicycle but does not include a motorcycle or

moped;

(

b) by adding the following after clause (e):

(e.1) "firearm" means a pistol, rifle, gun, slingshot, bow and

arrow or any other device that discharges a potentially

harmful missile;

(

c) by adding the following after clause (j)(xiv):

(xv) the discharge of firearms for the purposes of target

shooting.

3 The following is added after

section 1:

Purpose

1.1 The purpose of this Regulation is to govern access to

agricultural disposition land in a manner that benefits Albertans and

recognizes the economic, social and environmental importance of the

land.

Section 4(1) is amended by striking out ", facsimile

number".

Section 6(1) is amended by adding the following after

clause (d.1):

(d.2) the proposed use would involve the discharge of a

firearm for the purposes of target shooting or the use of

an explosive for those purposes;

6 The following is added after

section 9:

Guidance to recreational users

9.1(1) The holder of an agricultural disposition may give reasonable

guidance to a person using the agricultural disposition land for

recreational purposes for the purposes of

(

a) preventing harm from disease, infectious agents, biological

agents or toxins to the health and safety of persons, animals

or vegetation on the land,

(

b) preventing harm to the health and safety of persons using the

land from causes other than those described in clause (a),

(

c) preventing damage to the land, or

(

d) ensuring persons using the land avoid areas where livestock

are present.

(2) Guidance under subsection (1) may be given by the disposition

holder

(

a) in writing,

(

b) verbally,

(

c) by email, or

(

d) by other electronic means, as approved by the Minister.

Section 10 is amended

(

a) in subsection (2) by striking out ", or make any changes

to such a plan, unless the Minister first secures the agreement

to the plan or changes" and substituting "unless the

Minister first secures the agreement to the plan";

(

b) by adding the following after subsection (2):

(2.1) The Minister shall not amend or cancel a recreational

management plan unless the Minister is satisfied that all persons who

hold agricultural dispositions in respect of the land to which the plan

applies have been consulted with respect to the proposed amendment

or cancellation of the plan.

Section 11 is amended

(

a) by adding the following after subsection (1):

(1.1) A local settlement officer or director may amend or

remove a term or condition at any time if the local settlement

officer or director is satisfied that

(

a) the term or condition is no longer necessary,

(

b) the agricultural disposition that is subject to the term or

condition has been assigned to another disposition

holder under the Act or this Regulation, or

(

c) amending or removing the term or condition is required

to ensure reasonable access to the land that is subject to

the disposition to persons who wish to use the land for

recreational purposes.

(1.2) A local settlement officer or director may impose one or

both of the following conditions respecting access to agricultural

disposition land for recreational purposes that the local

settlement officer or director considers are necessary for the

purposes of proper land management, public safety or animal

health:

(

a) a restriction on the number of persons who may access

the land;

(

b) where multiple persons wish to gain access to the land,

a requirement that access be allocated to those persons

in accordance with a method determined by the local

settlement officer or director.

(

b) in subsection (2) by adding ", (1.1) or (1.2)" after

"subsection (1)".

Section 12(1) is amended by adding the following after

clause (a):

(a.1) require the agricultural disposition holder to restrict access to

all or part of the agricultural disposition land if the director is

satisfied that doing so is necessary to prevent harm from

disease, infectious agents, biological agents or toxins to the

health and safety of persons, animals or vegetation on the

land,

Section 13(3) is repealed and the following is

substituted:

(3) When an application is received under subsection (1), the local

settlement officer shall provide a copy of the application to the other

party.

Section 16(3) is repealed and the following is

substituted:

(3) When a request for review is received under subsection (2), the

local settlement officer shall provide a copy of the request to the

other party.

Section 20(4) is repealed and the following is

substituted:

(4) A review by a local settlement officer under

section 15 or by a

director under

section 16 may be conducted, as the local settlement

officer or director considers appropriate, by means of one or more of

the following:

(

a) discussions;

(

b) meetings held in person or by a method of electronic or

telephonic communication that enables all persons attending

the meeting to hear and communicate with each other

instantaneously, including teleconferencing and computer

network-based or internet-based communication platforms;

(

c) written submissions.

Section 24 is amended by adding "or" at the end of

clause (

b) and by repealing clause (c).

Section 25 is amended by striking out "March 31, 2025"

and substituting "March 31, 2035".

Wildlife Act

WILDLIFE (JOINT AUTHORITY) AMENDMENT REGULATION

1 The Wildlife Regulation (AR 143/97) is amended by this

Regulation.

2 The following is added after

section 51:

Allocated licences

51.1(1) An outfitter to whom an applicable licence allocation has

been issued under

section 54 or 54.00001, or transferred under

section 55, may purchase on behalf of a resident, non-resident or

non-resident alien an allocated licence available under the outfitter's

allocation.

(2) A resident, non-resident or non-resident alien hunting under the

authority of an allocated licence must be accompanied by a

designated guide while hunting in accordance with the Act and this

Regulation.

Section 53(1) is repealed and the following is

substituted:

Designated guide authorization - entitlements

53(1) Subject to this section, the big game guide's designation

referred to in

section 52(1)(

a) authorizes the designated guide who

holds it, at any one time, to guide for gain or reward,

(

a) under a contract referred to in

section 58(1)(

a) or 59(1)(a), up

to 3 non-resident or non-resident alien licence holders, in any

combination, while the licence holders are hunting wolf,

coyote or big game that the licence holders are legally

authorized to hunt, or

(

b) any number of resident licence holders while the licence

holders are hunting any animal that the licence holders are

legally authorized to hunt.

Section 69 is amended

(

a) in subsection (3) by striking out "(2) (

a) or (b)" and

substituting "(2)(a)";

(

b) by adding the following after subsection (3):

(4) Instead of exporting the animals referred to in subsection

(2)(b), the import permit also authorizes its holder to traffic in

them with a holder of a zoo permit issued in Alberta.

Section 96 is amended

(

a) in clause (a)

(

i) in subclause (

i) by adding ", excluding endangered

bats," after "endangered animals";

(ii) by adding "and" at the end of subclause (i.1),

striking out "and" at the end of subclause (ii)

and repealing clause (iii);

(

b) by adding the following after clause (a.2):

(a.3) to the dens of bats used as birthing roosts throughout

Alberta from June 1 to August 31,

Section 112(2) is repealed and the following is

substituted:

(2) For the purposes of

section 42(1) of the Act, a client may hunt

wolf, coyote or big game unaccompanied by another person referred

to in that subsection if

(

a) the client was accompanied by such a person earlier in the

same day,

(

b) such a person can locate the client at all times after the two

have parted company, and

(

c) the client is again accompanied by such a person later in the

same day.

Section 113(1) is repealed and the following is

substituted:

Guiding

113(1) A big game designated guide shall not, at any one time,

guide more than 3 non-resident or non-resident alien licence holders,

in any combination, while hunting wolf, coyote or big game.

Section 135 is amended

(

a) in subsection (1) by striking out ", a skunk or a bat"

and substituting "or skunk";

(

b) in subsection (2) by striking out ", skunk or bat" and

substituting "or skunk".

9 The following is added after

section 135:

Possession of bats

135.1 A person may temporarily possess a live bat that is a

non-game animal for the purpose of capturing it and relocating it

from that person's property.

Section 153.4 is repealed.

Schedule 1,

section 16(1) is amended by striking out

"or" at the end of clause (a), adding "or" at the end of clause

(

b) and adding the following after clause (b):

c) a bat that is a non-game animal that is possessed in

accordance with

section 135.1 of this Regulation,

1 The Alberta Energy Regulator Administration Fees Rules

(AR 70/2019) are amended by this Regulation.

Section 2(2) is amended by striking out "for the 2024-2025

fiscal year is December 31, 2023" and substituting "for the

2025-2026 fiscal year is December 31, 2024".

Section 3 is amended

a) by repealing subsection (2) and substituting the

Oil Sands Conservation Act, as approved as of December 31 of

the base year.

b) in subsection (1) by striking out "if the processing plant"

and substituting "if the associated approval under

section 11

or 13 of the Oil Sands Conservation Act";

(

c) by repealing subsections (2) and (3) and substituting

the following:

(2) The administration fee shall be calculated as follows:

administration fee = approved capacity (expressed in

cubic metres) x $4.942246 for each cubic metre per day

(3) For greater clarity, for the purposes of calculating the

administration fee in subsection (2), if a processing plant

processes gas, its approved capacity in thousand cubic metres is

to be adjusted by a conversion factor of 1.00.

1 The Oil and Gas Conservation Rules (AR 151/71) are

amended by this Regulation.

Section 16.510 is repealed and the following is

substituted:

16.510 In this Part, "facility" means facility as defined in

Part 11

of the Act.

Section 16.520 is amended by striking out "All facilities,

wells and unreclaimed sites" and substituting "All facilities and

wells".

Section 16.521 is repealed.

Section 16.530(1) is repealed and the following is

substituted:

16.530(1) For the 2025-2026 fiscal year of the Regulator, the

orphan fund levy payable by a licensee or approval holder is

calculated in accordance with the following formula:

Levy = A x $144 450 000

where

A is the sum of the licensee's or approval holder's estimated

liability on March 27, 2025, as determined by the Regulator

in accordance with Directive 011, for each type of licence

and approval in Appendix 1 of Directive 011 that is included

in the calculation of the orphan fund levy, and

B is the sum of the industry's estimated liability on March 27,

2025, as determined by the Regulator in accordance with

Directive 011, for each type of licence and approval in

Appendix 1 of Directive 011 that is included in the

calculation of the orphan fund levy.

Section 16.531 is repealed.
