section 3.2 of the Civil Service Act,

chapter C-5.1 of the Acts of New Brunswick, 1984, is repealed. 1 La rubrique « SERVICES NOUVEAU- BRUNSWICK » qui précède l’article 3.2 de la

a) by repealing paragraph (d.1);

e) and substituting the following:

Le paragraphe 4.1(1) de la Loi est abrogé et rem- placé par ce qui suit : 4.1(1) If the Secretary to Treasury Board has delegated any of his or her powers or duties under this Act to a deputy head, the Secretary to Treasury Board shall en- sure that the deputy head, and any delegate of the deputy head, is exercising those powers and duties in the man- ner required and in accordance with the terms and condi- tions of the delegation and the requirements of this Act. 4.1(1) Il incombe au secrétaire du Conseil du Trésor qui a délégué des pouvoirs ou des fonctions à un admi- nistrateur général tel que le prévoit la présente loi de s’assurer que cet administrateur général et ses déléga- taires exercent les pouvoirs et les fonctions délégués dans le respect des paramètres de la délégation et des dispositions de la présente loi. 8

Section of the Act is amended by adding the fol- lowing after subsection (8): 8 L’article de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (8) : 17(9) An exemption under subsection (4) or an exclu- sion from the application of this

section referred to in a regulation under

section shall not have the effect of giving a temporary or casual employee permanent em- ployment. 17(9) Ni l’exemption prévue au paragraphe (4) ni une exclusion de l’application du présent

Section of the Act is repealed and the following is substituted: 9 L’article de la Loi est abrogé et remplacé par ce qui suit : 34 Deputy heads and employees shall give the Ombud access to their respective offices and facilities and pro- vide assistance and information as the Ombud may re- quire for the performance of the Ombud’s duties under this Act. 34 Les administrateurs généraux et les employés doivent donner à l’ombud libre accès à leurs bureaux et installations respectifs ainsi que toute l’assistance et les renseignements dont il a besoin dans l’exercice des fonc- tions que lui confère la présente loi.
