EXPLANATORY NOTE NOTE EXPLICATIVE Under The Public Health Act, a person who fails to comply with a communicable disease order may be apprehended and detained if the person presents a threat to public health. A person may also be temporarily detained because of their exposure to a virulent and highly communicable disease or a contaminant. Amendments are made to permit detention only in a hospital or other facility set out in the regulations. A detention order must now be made by a provincial court judge and not a justice of the peace.
