B.C. Reg. 309/2002, deposited November 22, 2002, pursuant to the INSURANCE (MOTOR VEHICLE) ACT [Section 45]. Order in Council 1010/2002, approved and ordered November 22, 2002.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, B.C. Reg. 447/83, is amended as set out in the attached Appendix,

(

a) effective on the date this Order is deposited with the Registrar of Regulations in respect of a certificate, policy or endorsement

(

i) that is not a renewal, and

(ii) that takes effect on or after the date this Order is deposited with the Registrar of Regulations, and

(

b) effective January 1, 2003, for all other purposes. — G. COLLINS, Minister of Finance; G. CAMPBELL, Presiding Member of the Executive Council.

Appendix

Section 1 (1) of the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, B.C. Reg. 447/83, is amended by adding the following definition:

"location address" means the place where a vehicle is primarily kept when not in use but does not include a work location; .

Section 9 is amended

(

a) by adding "or" at the end of paragraph (b) (ii),

(

b) by adding the following paragraph:

(

c) if the vehicle described in the certificate is rated in vehicle rate class 001, 002, 003, 004, 005, 007, 021, 022, 023, 024 or 027 in a territory other than territory Z and the insured has purchased own damage coverage under Division 2 of

Part 9 for the vehicle, except where the vehicle is being used by the insured for vacation purposes, within 60 days after the location address of the vehicle is changed from the location address set out in the certificate, , and

(

c) by striking out "report the change of address, vehicle, use or territory" and substituting "report the change of address, vehicle, use, territory or location address".

Section 55 (2) is amended by adding "except for statements regarding the location address of a vehicle" after "Subject to

section 2 of Table 2 of

Schedule 1,".

Section 55 is amended by adding the following subsection:

(2.1) An insured shall be deemed to have breached a condition of Division 2 of

Part 9 if the insured keeps a vehicle at a location address other than the location address declared in the application for insurance for the vehicle unless the premium paid for own damage coverage under Division 2 of

Part 9 with respect to the declared location address equals or exceeds the premium payable for the own damage coverage with respect to the actual location address.
