B.C. Reg. 96/2005, deposited March 18, 2005, pursuant to the EXPROPRIATION ACT [Section 54]. Order in Council 210/2005, approved and ordered March 17, 2005.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective March 18, 2005, the Expropriation Act General Regulation, B.C. Reg. 451/87, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Expropriation Act General Regulation, B.C. Reg. 451/87, is amended

(

a) by repealing the definition of "board" , and

(

b) by adding the following definition:

"court" means the Supreme Court.

Section 4 is amended

(

a) in subsections (1) and (3) by striking out "board" and substituting "court", and

(

b) in subsection (4) by striking out everything after "security interest" and substituting "the court must determine the market value of the expropriated part and must allocate the compensation between the security holder and the other owners as it considers just in the circumstances."

Section 5 (2) is amended by striking out "board" and substituting "court".

Section 5 of Form 1 is amended by striking out "Expropriation Compensation Board" and substituting "minister".

5 Form 2 is amended

a) by striking out
