Reg. 65/2002, deposited March 28, 2002, pursuant to the LIQUOR CONTROL
AND LICENSING ACT [section 84]. Order in Council 245/2002, approved and ordered
March 28, 2002.
On the recommendation of the undersigned,
the Administrator, by and with the advice and consent of the Executive Council,
orders that, effective April 2, 2002, the Liquor Control and Licensing Regulations,
B.C. Reg. 608/76, are amended as set out in the attached Schedule. — R. COLEMAN,
Minister of Public Safety and Solicitor General; G. CAMPBELL, Presiding
Member of the Executive Council.
Schedule
section 17 of the Liquor Control and Licensing Regulations, B.C. Reg. 608/76,
is amended
(
a) in subsection (7) (
a) by striking out "the sale of liquor
shall be restricted to beer, wine, cider or coolers" and substituting "all types
of liquor May be sold, subject to limitation by the general manager in the licence,",
(
b) in subsection (7) (
e) by striking out "1 000" and substituting "2 000", and
(
c) by repealing subsection (8) (
b) and substituting the following:
(
b) the maximum allowable floor space shall not exceed the greater of
(
i) the floor space approved by the general manager as of December 9, 1988, and
(ii) 2 000 square feet.
section 24.2 (2.1) is repealed and the following
substituted:
(2.1) Without limiting subsection
(2) but subject to subsection (2.11), a licensed establishment advertisement that
is an advertisement or is a sign referred to in subsection (2) (
a) May include
a statement,
(
a) if the licence held in respect of
the establishment is endorsed for off-premises sales, that off-premises sale of
beer, wine, cider and coolers is available, or
(
b) if the licence held in respect of the establishment is a G or an H licence, that
off-premises sale of the types of liquor that May be sold under the licence is
available.
(2.11) A licensed establishment advertisement
referred to in subsection (2.1) (
a) or (
b) must not mention the price of the liquor
products, or the brands or manufacturers of the liquor products, of which off-premises
sale is available.
