SCHEDULE The Bylaws made by the College of Opticians of British Colun ibia under the authority of the Health Professions Act are amended as follows: 1.

Section 3 (1) to amend the electoral boundaries by combining Electoral district 4 with Electoral district 3 3(1) would now reads as follows: The following electoral districts are established for the purpose of the election of the members of the board. 1. Electoral district 1 Lower Mainland 2. Electoral district 2 Vancouver Island 3. Electoral district 3 Okanagan and Kootenays 4. Electoral district 4 Cariboo 5. Electoral district 5 (The nominee must be a registrant registered as a contact lens fitter with the College of Opticians) 2.

Section 3(4) amended by striking out "electoral district 6" and substituting "electoral district 5" and by striking out "Electoral Districts 1 to 5", and substituting "Electoral Districts 1 to 4" 3.

BOARD RESOLUTION THE BOARD OF THE COLLEGE OF PHYSICAL THERAPISTS OF BRITISH COLUMBIA DO HEREBY RESOLVE TO AMEND THE COLLEGE BYLAWS AS FOLLOWS. THIS RESOLUTION ADOPTED AT THE REGULAR MEETING OF THE BOARD OF THE COLLEGE OF PHYSICAL THERAPISTS OF BRITISH COLUMBIA HELD NOVEMBER 6, 1999. Amendment # 1. Add

section in

definitions; Good standing: Membership rights are not constrained or limited. Amendment #2; Delete references to Standards in sections 11(2) and 11(3). Amendment # 3. Repeal section. 15 (4) and renumber current

section 15 (5) to 15 (4) as follows.

(4) Continuing Competence (

a) The continuing competence committee is a sub committee of the quality assurance committee and reports to the quality assurance committee and the board. (

b) The continuing competence committee is responsible for reporting to the board, recommendations for establishing and monitoring adherence to standards for maintenance of competence for registrants. (

c) The continuing competence committee is established consisting of at least five (5) registrants. Amendment # 4. Repeal

section 20 (2)(

d) and replace with the following. 20. (2) (

d) have the same authority as the registrar under these bylaws where the deputy registrar is performing the duties of the registrar pursuant to sections 20(2)(b). Amendment/1, In

section 24 replace letters with numbers as follows. 24. The board may (

I) enter into agreements with any person on behalf of a person or class of persons registered under these bylaws and, subject to the bylaws, registrants are bound by such an agreement entered into by the board on their behalf, (2) raise or secure the payment or repayment of money on behalf of and in the name of the college, in the manner it decides, in order to carry out the purposes of the college, and (3) invest, and change investments, of funds of the college in lawful securities for the establishment of trust funds in the name of the college.

Amendment # 6, Repeal

section 32 (e) (

i) and replace with the following. 32 (e) (

i) proof of membership in good standing in the jurisdiction in which they have last worked or in the case of a new graduate proof of eligibility for registration as a physical therapist in the jurisdiction in which the applicant was educated, Amendment #1. Repeal

section 38(1) and replace with the following. 38.

(1) A person is entitled to be registered under this

section who : Amendment # 8, Repeal

section 38)1)(

b) and replace with "applies in writing to the College,". Amendment # 9, Repeal

section 46(1) and replace with the following. 46

(1) All registrants of the College and their employees must be insured at all times against liability for negligence in an amount of at least $3 million per occurrence. Amendment # 10, In sections 53 (

n) repeal "or", (

o) repeal . (period) and add, (comma) or and add a new

section (p) "breaching an undertaking provided to the College pursuant to

section 36 of the Act.". Amendment # 11. Repeal

section 55 (2) (1) and replace with the following. 55 (2)

(1) Physical Therapists must comply with all the laws and regulations pertaining to all aspects of the practice of physiotherapy. Amendment # 12, Repeal

section 57(3) and replace with the following. 57

(3) A registrant must not enter into an agreement whereby he or she pays rental or other overhead costs based on a percentage of client billings received to an individual who is not a member of the College. Amendment # 13, Repeal sections 62(6), (9((

c) and (10) and replace with the following. 62

(6) Notwithstanding section (5), a permit issued to a health profession corporation ceases to be valid if (

a) it is revoked under

section 44 of the Act, (9) (

c) The board must, subject to

section 43(2) of the Act, issue a renewal permit entitling the health profession corporation to carry on the business of providing physical therapy services to the public if the health profession corporation has applied to the board for a renewal of its permit in accordance with

section 43(1) and has complied with the Act and these bylaws,

(10) If a company which has had its permit revoked under

section 44 of the Act wishes to obtain a new permit, it must apply to the board in a form approved by the board in which case subsections (1) and (2) apply. Amendment # 14, Repeal

section 63 (1) and replace with the following. 63.

(1) Upon receipt of a complaint, the registrar or an inspector appointed pursuant to

section 27 of the Act, may investigate any matter which may be the subject of a hearing pursuant to

section 44 of the Act; Amendment # 15, Repeal

section 63(8) and replace with the following:

63(8) The panel may order the attendance of a person, including a registrant or shareholder, at a hearing to give evidence, and/or to produce records or objects in his or her possession or under his or her control at the hearing, by issuing a subpoena in the form attached to these bylaws. Amendment # 16. Repeal former Appendix 1 and replace with the following. Appendix 1: Subpoena IN THE MATTER OF THE COLLEGE OF PHYSICAL THERAPISTS OF BRITISH COLUMBIA and IN THE MATTER OF A HEARING PURSUANT TO

SECTION 38 OF THE HEALTH PROFESSIONS ACT INTO THE CONDUCT OF SUBPOENA TO: TAKE NOTICE that you are required to attend to testify as a witness at the time, date and place set out below, pursuant to provisions of s. 38 of the Health Professions Act, S.B.C., c. 183. You are also required to bring with you all documents in your possession or power relating to the matters in question in this proceeding. Please note the provisions of the Health Professions Act and the bylaws of the College of Physical Therapists reproduced on the back of this Subpoena.
