section 80 of the Industrial Relations Act,

chapter I-4 of the Revised Statutes, 1973, is repealed and the following is substituted: 1 La rubrique « Corps de pompiers, agents de po- lice » qui précède l’article 80 de la

Section 80 of the Act is amended 2 L’article 80 de la Loi est modifié (

a) in subsection (1.1) in the portion preceding paragraph (

a) by striking out “within the meaning of subsection 1(3) or (3.1)” wherever it appears and substituting “within the meaning of subsection 1(3), (3.1) or (3.11)”;

b) by adding before the heading “Non-application of Arbitration Act” preceding

section 81 the follow- ing:

a) a comparison of the percentage adjustments in the wages and benefits, resulting from collective bar- gaining or arbitral awards, of,

a) le résultat de la comparaison des rajustements, exprimés en pourcentages, des salaires et avantages qui résultent de négociations collectives ou de sen- tences arbitrales visant : (

i) when the employer is a local government, other unionized employees of that local govern- ment, or, (

i) ou bien les autres salariés syndiqués ou em- ployés syndiqués du gouvernement local, lorsque celui-ci est l’employeur, (ii) when the employer is a board of police com- missioners, the unionized employees of the munici- pality that approved its establishment under

section 7 of the Police Act or those of the municipalities that are party to an agreement under

section 17.1 of that Act; (ii) ou bien les employés syndiqués, soit de la municipalité qui a approuvé, conformément à l’ar- ticle 7 de la

b) a comparison of the wages and benefits, result- ing from collective bargaining or arbitral awards, of firefighters or police officers, as the case may be, em- ployed by comparable employers in the Province, considering the relative fiscal and economic health,

b) le résultat de la comparaison des salaires et avan- tages résultant de négociations collectives ou de sen- tences arbitrales visant les pompiers ou les agents de police, selon le cas, qui sont des salariés ou des em- ployés d’employeurs comparables dans la province, compte tenu de la santé financière et économique re- lative : (

i) when the employer is a local government, of that local government, or, (

i) du gouvernement local concerné, lorsque celui-ci est l’employeur, (ii) when the employer is a board of police com- missioners, of the municipality or municipalities that approved its establishment under

b) and there are no comparators with any employer in the Province, a comparison of the wages and benefits resulting from collective bargaining or arbitral awards of firefighters or police officers, as the case may be, employed by comparable employers in the Province of Nova Scotia, the Province of Prince Edward Island or the Province of Newfoundland and Labrador, considering the relative fiscal and economic health of the employer concerned;

d) a comparison of the percentage adjustments in the wages and benefits, resulting from collective bar- gaining or arbitral awards, of unionized employees in bargaining units to which the Public Service Labour Relations Act applies;

e) the fiscal and economic health,

h) the employer’s ability to attract and retain quali- fied firefighters or police officers, as the case may be.

section read immediately before the commencement of this Act, con- tinues to apply in respect of the dispute to which the application relates, including any appeal of any deci- sion or award made in respect of that dispute. l’Assemblée législative, l’article 80 de la
