DONALD ARSENEAULT M. DONALD ARSENEAULT 1 2012 BILL 14 Tanning Beds Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows:

Definitions 1 The following

definitions apply in this Act. “employee of an owner” includes any servant or agent of the owner. (employé du propriétaire) “enforcement officer” means a person designated pur- suant to this Act as an enforcement officer and includes a member of a municipal police force within the meaning of the Police Act and a member of the Royal Canadian Mounted Police. (agent d’exécution) “Minister” means the Minister of Health. (ministre) “owner” means a person, firm, corporation or unincor- porated body that owns or operates a tanning facility. (propriétaire) “tanning equipment” means ultraviolet or other lamps intended to induce skin tanning through the irradiation of any part of the living human body with ultraviolet radia- tion and equipment containing such lamps, including bal- lasts, starters, acrylic shields, timers and airflow cooling systems. partie du corps d’une personne vi- vante au rayonnement ultraviolet ainsi que tout appareil contenant une lampe de ce genre, y compris ballasts, dé- marreurs, volets en acrylique, minuteries et systèmes de refroidissement de l’air. (tanning equipment) « employé du propriétaire » Vise notamment les pré- posés et mandataires du propriétaire. ( employee of an owner) « ministre » Le ministre de la Santé. (Minister) « propriétaire » La personne physique ou morale, le commerce ou l’organisme non personnalisé à qui appar- tient le salon de bronzage ou qui l’exploite. (owner) 2 Projet de loi 14

Loi sur les lits de bronzage “tanning facility” means any location, place, area, structure or business that provides customers access to tanning equipment in exchange for compensation. ( salon de bronzage) Designation of enforcement officers 2 The Minister may designate persons or classes of per- sons to act as enforcement officers for the purpose of this Act and the regulations.

Prohibition against selling services to underage persons 3(1) No owner or employee of an owner shall sell access to tanning equipment to a person under the age of 19 years. 3(2) An owner or employee of an owner who violates or fails to comply with subsection (1) commits an offence. 3(3) It is not a defence to a prosecution pursuant to sub- section (1) for the owner or employee of an owner to show that the person under the age of 19 years appeared to be above that age. 3(4) An owner or an employee of an owner shall require a person appearing to the owner or employee to be under the age of 19 years to provide proof of age before selling access to tanning equipment to that person and shall carry out such procedures as may be prescribed by the regula- tions.

Signage 4(1) An owner shall display signs in such form and manner and disclosing such information relating to the sale of access to tanning equipment and the effect of tan- ning on health as may be prescribed by the regulations. 4(2) No person shall display or permit the display of any sign or material promoting or advertising the sale of ac- cess to or otherwise respecting the use of tanning equip- ment except as prescribed by the regulations. Enforcement 5 For the purpose of enforcing this Act and the regula- tions, an enforcement officer may (

a) make test purchases of accessing the use of tan- ning equipment; « salon de bronzage » Lieu, endroit, espace, structure ou entreprise qui donne accès à des clients à des appareils de bronzage contre rémunération. Interdiction de vendre des services aux personnes n’ayant pas l’âge requis 3(1) Il est interdit au propriétaire ou à un employé du propriétaire de vendre l’accès à un appareil de bronzage à une personne âgée de moins de 19 ans. 3(2) Commet une infraction le propriétaire ou l’em- ployé du propriétaire qui contrevient au paragraphe (1) ou qui omet de s’y conformer. 3(3) Ne constitue pas une défense à une poursuite pour infraction au paragraphe (1) le fait pour le propriétaire ou l’employé du propriétaire de démontrer que la personne âgée de moins de 19 ans semblait plus âgée. 3(4) Le propriétaire ou l’employé du propriétaire doit exiger de toute personne qui semble être âgée de moins de 19 ans une preuve de son âge avant de lui vendre l’accès à un appareil de bronzage et doit prendre les mesures pré- vues par règlement.

Affichage 4(1) Le propriétaire doit se conformer à toute prescrip- tion réglementaire régissant la forme des affiches, la ma- nière de les apposer et les renseignements à donner sur la vente de l’accès aux appareils de bronzage et les effets du bronzage sur la santé. 4(2) Il est interdit d’exposer ou de permettre que soient exposées des affiches ou autre matériel encourageant ou annonçant la vente de l’accès à des appareils de bronzage ou portant sur leur utilisation, sauf en conformité avec les règlements.

Application de la Loi 5 Dans le but d’appliquer la présente loi et ses règle- ments, l’agent d’exécution peut :

a) tester l’achat de l’accès à un appareil de bronzage; 3 Tanning Beds Act Bill 14 (

b) investigate any complaint of a contravention of this Act or the regulations and examine an owner or employee of an owner to determine if a contravention has occurred; (

c) from time to time and at all reasonable times, en- ter upon a tanning facility’s premises if it is reasonably necessary to do so in order to determine whether this Act and the regulations are being complied with; (

d) do any other thing for the purpose of enforcing this Act and the regulations. Indemnification 6 No action lies against a person by reason of that per- son reporting a contravention or alleged contravention of this Act or the regulations unless the reporting is done falsely and maliciously. Regulations 7 The Lieutenant-Governor in Council may make regu- lations (

a) prescribing any matter that this Act authorizes to be prescribed by the regulations; (

b) prescribing penalties for non-compliance with this Act; (

c) respecting any matter that the Lieutenant- Governor in Council deems necessary or advisable to carry out the intent and purpose of this Act. Commencement 8 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

d) faire d’autres choses pour assurer l’application de la présente loi et des règlements. Mise à couvert 6 Aucune poursuite ne peut être intentée à une personne en raison du fait qu’elle a signalé une infraction ou préten- due infraction à la présente loi ou aux règlements, à moins qu’elle ait agit fallacieusement et avec malveillance. Règlements 7 Le lieutenant-gouverneur en conseil peut, par règle- ment :

a) prescrire les choses que la présente loi permet de prescrire par règlement;

b) fixer les pénalités pour inobservation de la pré- sente loi;

c) réglementer sur toute autre question qu’il estime nécessaire ou souhaitable pour réaliser l’objet et l’es- prit de la présente loi. Entrée en vigueur 8 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur à la date ou aux dates fixées par proclamation.
