Section 9 of the New Brunswick Liquor Corporation Act,

chapter N- 6.1 of the Revised Statutes, 1973, is re- pealed and the following is substituted: 1 L’article 9 de la

chapitre N-6.1 des Lois révisées de 1973, est abrogé et remplacé par ce qui suit : 9(1) The Lieutenant-Governor in Council shall appoint a President of the Corporation for a term not exceeding five years. 9(1) Le lieutenant-gouverneur en conseil nomme le pré- sident de la Société pour un mandat maximal de cinq ans. 9(2) The President shall be appointed from among those persons nominated by the Board in accordance with sub- section (7). 9(2) Le président est nommé parmi les candidats que propose le Conseil conformément au paragraphe (7). 9(3) The President is the Chief Executive Officer of the Corporation and is, subject to the direction of the Board, charged with the general direction, supervision and control of the business of the Corporation and may exercise any other powers and duties conferred on him or her by the by- laws of the Corporation or by this Act. 9(3) Le président est le premier dirigeant de la Société et, sous réserve de la direction du Conseil, est chargé gé- néralement de la direction, de la surveillance et du contrôle des affaires de celle-ci et peut exercer les autres pouvoirs et fonctions que lui confèrent ses règlements administratifs ou la présente loi. 9(4) The President shall be paid the remuneration that the Lieutenant-Governor in Council determines, and the payment shall be made out of the funds of the Corporation. 9(4) Le président reçoit sur les fonds de la Société la rémunération que fixe le lieutenant-gouverneur en conseil. 9(5) In determining the remuneration of the President, the Lieutenant-Governor in Council shall consider any recommendation made by the Board. 9(5) En fixant la rémunération du président, le lieutenant-gouverneur en conseil tient compte de toute re- commandation que fait le Conseil. 1

9(6) Before making nominations under this section, the Board shall advise the Lieutenant-Governor in Council of the skills and qualification requirements for nominees for the position of President. 9(6) Avant de proposer des candidats en vertu du présent article, le Conseil avise le lieutenant-gouverneur en con- seil des aptitudes et des compétences que doivent posséder les candidats au poste de président. 9(7) In making nominations under this section, the Board shall 9(7) Lorsqu’il propose des candidats en vertu du présent article, le Conseil : (

b) ensure that nominees have the necessary skills and qualifications to hold the office of President, and

9(14) The President shall devote his or her whole time and attention to the performance of his or her functions for the Corporation and shall engage in no other occupation. 9(14) Le président consacre tout son temps et donne tous ses soins à l’exercice de ses fonctions pour la Société; il n’exerce aucune autre profession. 9(15) The President is, by virtue of the office, a member of the Board. 9(15) Le président est membre d’office du Conseil. 2 Subsection 10(2) of the Act is repealed and the fol- lowing is substituted: 2 Le paragraphe 10(2) de la Loi est abrogé et remplacé par ce qui suit : 10(2) The remuneration and other conditions of em- ployment of the employees, other than the remuneration referred to in subsection 9 (4), shall be established by the by-laws of the Corporation. 10(2) La rémunération et les autres conditions de travail des employés, sauf la rémunération visée au paragraphe 9(4), sont fixées par les règlements administratifs de la Société. 3 Despite subsections 9(1) and 9(2) of the New Bruns- wick Liquor Corporation Act, as amended by

section 1 of this amending Act, the President of the New Brunswick Liquor Corporation in office immediately before the commencement of this amending Act shall, on the com- mencement of this amending Act, continue to hold the office of President until he or she resigns or is removed under subsection 9 (10) of the New Brunswick Liquor Corporation Act. 3 Par dérogation aux paragraphes 9(1) et 9(2) de la
